What the inspector wrote

On 05/22/25, at 1:45pm an unannounced Annual Random inspection was conducted at the facility by Licensing Program Analyst (LPA) Anna Chan. LPA was met by male adult in the home. Licensee arrived at 2pm to continue with the visit. Licensee was operating within the licensed capacity as specified on license. There were no children present at the time of visit. Licensee stated there are 3 school-age children enrolled at the facility. A review of the Facility Personnel Report Summary on this date indicates all facility residents, staff, or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions. Currently only the licensee is living in the facility. Facility Day care hours are 6:00am-6:00pm, Monday through Friday. During today\342\200\231s inspection, LPA and licensee toured the inside and outside areas identified in the facility sketch as accessible to childcare children. There is a childcare area next to the living room, whcih has its own entrance from outside. There is 1 bathroom on the right of the hallway passed the living room. And a side yard and backyard. The facility conducted disaster drill on 05/01/25. There are working carbon monoxide, smoke detector, and fire extinguishers in the home that meet statutory and State Fire Marshal standards. Detergents, cleaning compounds, medicines, and other items which could pose a danger if readily available to children were stored inaccessible to children. Page 1 of 4 There were no poisons or other items observed which could pose a danger to children or if they were observed, they were locked or inaccessible. Licensee stated there are no firearms and/or other dangerous weapons in the facility and none were observed during today's inspections. There is a fireplace in the living room barricaded by a mesh covering. The home has age-appropriate toys for the ages served. LPA verified there is a working telephone service (cellular service), licensee was reminded that childcare phone needs to remain the in the childcare at all times. The facility does have bodies of water which is an in-ground pool. LPA inspected and completed the bodies of water checklist. The facility does not meet the Pool Safety regulation AB-2866 Pool safety . There were 3 vertical fence bars on the right side of the pool that are broken and rusted at the bottom and has small gaps in between and needs to be fixed immediately. The vertical clearance from the ground is 2 inches more of the standard requirement. There is a body hook but no pole attachment. The licensee purchased a Pool Alarm that meet the ASTM standards, but it is not installed. There is an 18\342\200\235 Life Ring without US Coast Guard label of approval and Pool Log is not available. Based on interview with Licensee, licensee stated they are in the process of getting different proposal and estimates to fix the fence immediately. Licensee stated the children enrolled are only school-age children. Licensee stated, to ensure safety of the children, children do not go outside to play and stay indoors. The licensee does have a current roster of children in care. 1 Child record was reviewed for a copy of the emergency information card that contains all the information specified by regulation (LIC 700), Immunization records, Affidavit Regarding Liability Insurance (LIC282), Consent for Emergency Medical Treatment (LIC627), Notification of Parent\342\200\231s Rights (LIC995A) and found to be in compliance. Licensee stated, there are no infants enrolled in the child care. Licensee stated they transport children to school and from school. The licensee\342\200\231s EMSA Approved Pediatric CPR/First Aid certification expires on 08/2025. Beginning September 1, 2016, Health and Safety (H&S) 1597.622 states, a person shall not be employed or volunteer at a family childcare home if he or she has not been immunized against influenza, pertussis, and measles. Proof of immunization against pertussis, measles for both licensees were reviewed and within compliance. Beginning March 31, 2018, H&S Code 1596.8662 requires all licensed providers and employees to complete mandated reporting training, and to renew the training every two years. Page 2 of 4 This facility will provide Incidental Medical Services if necessary \342\200\223 IMS. LPA reviewed storage of medication and equipment/supplies, and reviewed children\342\200\231s, personnel, and administrative records. Children are not to be left alone in parked vehicles. When the licensee is temporarily absent from the facility, arrangements must be made for a qualified substitute adult to care and supervise children while absent. The substitute adult must have the required criminal record, child abuse index clearances, immunizations, Pediatric CPR/First Aid, and mandated reporter training. LPA provided Guardian Information and website info: https://www.cdss.ca.gov/inforesources/cdss-programs/community-care-licensing/caregiver-background-check/guardian In the areas that were evaluated, 1 Type A and 1 Type B deficiencies were observed of the California Code of Regulations, Title 22, Division 12, Physical Plant \342\200\223 1 Type A: Health and Safety Code 1596.814(a)(1)(A)(iii) Pool Safety. 1 Type B: Health and Safety Code 1596.814(a)(1)(B) Pool Safety Page 3 of 4 LPA Chan informed licensee, Maryam Fahid, that this report dated 05/22/25 documents 1 Type A citation which shall be posted for 30 consecutive days as there is immediate risk to the health, safety, or personal rights of children in care. Also, LPA Chan informed the licensee Fahid to provide a copy of this licensing report dated 05/22/25 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. Exit interview conducted and report was reviewed with the licensee, Maryam Fahid. A notice of site visit was posted and must remain posted for 30 days. Appeal Rights was provided. Page 4 of 4
