What the inspector wrote

Licensing Program Analyst (LPA) Romy Castanon and LPA Archibaldo Silva conducted an on site inspection for the purpose of a 1 year Annual. LPA and Director Lily Huerta toured inside and outside of the facility. The floor and yard plan (LIC 999) were verified. Census was taken in each individual classroom P1, P2, T1, T2, and T3. LPA observed a total of 52 children including Toddler Option of 11 and 10 staff. Facility hours are Monday through Friday 6:30 AM to 6:00 PM. During the inspection it was determined the facility is operating within its licensed capacity and within compliance of staffing ratios. A review of the Facility Personnel Report Summary on this date indicates 9 out of 10 facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions. Upon Guardian record review, it was determined that 1 staff member’s clearance was still processing. During the inspection of the indoor activity space, LPA did not observe any items which could pose a danger to children (poisons, detergents, cleaning compounds, medications or hazardous items). Families provide large water jugs or gallons for drinking water available indoors for children in care. Children also bring their water bottles from home to refill as needed. The children's bathrooms are clean and sanitary. Bedding is sent home on a weekly basis to be laundered. Food is not prepared on site; lunch and snacks are brought from home. Food prep area observed to be clean and sanitary. Food is properly stored. Each child has their own labeled lunch box. Floors, equipment, and furniture were clean and were observed to be in good repair and free of sharp edges. The facility has conducted an emergency drill within the past six months, last conducted on 01/06/2023. The facility has a working carbon monoxide detector and fire alarm. Facility met all posting requirements. The California Child Passenger Safety Law was posted by the entrance of the facility. Continue to page 2 Page 2 The outdoor activity space was inspected for compliance. The playground was enclosed by a fence at least five feet in height. The surface of the outdoor activity space was well maintained and free of hazards. The cushioning material commercially produced for the purpose around the climbing equipment, structures, slides and other similar equipment appeared to be enough to absorbs falls. Drinking water in the outdoor activity space is also provided by large water jugs and gallon and children’s personal water bottles. The outdoor equipment and toys were in good repair and free of sharp edges. There are no bodies of water present at the facility. The facility grounds were safe, sanitary and in good repair. Staff files were reviewed for staff present during the facility inspection this date; 5 staff files were reviewed. Health screening and immunizations as required were reviewed. Beginning September 1, 2016, Health and Safety (H&S) 1597.622 states, a person shall not be employed or volunteer at a childcare center if he or she has not been immunized against influenza, pertussis, and measles. Proof of immunization against pertussis, measles for 5 out of 5 staff were reviewed and within compliance. Beginning March 31, 2018, H&S Code 1596.8662 requires all directors and employees to complete mandated reporting training, and to renew the training every two years. 5 out of 5 staff had Mandated Reporter Training certificates. At least 1 staff member present possess current EMSA approved Pediatric CPR/First Aid certifications, which expires 06/2023. Children's records were reviewed, and there was a separate, complete and current record for each child. A random sample of 5 children's files were reviewed for documentation of the child’s name, address, and telephone number of the child’s authorized representative and of relatives or others that can assume responsibility for the child if the authorized representative cannot be reached when necessary (LIC 700) and a medical assessment. In the areas reviewed the children’s files were found to be in full compliance. Sign in/out procedure was reviewed for compliance. The person signing the child in/out using their full legal signature. The director was informed, and website given, about the California Child Care Disaster Plan has been posted to the UCSF California Childcare Health Program website: cchp.ucsf.edu/content/disaster-preparedness Also provided was information about the E-Learning Modules available at https://ccld.childcarevideos.org . Director was reminded that all adults 18 and over, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated. Continue to page 4 Page 4 In the areas that were evaluated, 3 deficiencies were observed of the California Code of Regulations, Title 22, Division 12 at the time of the visit; 101429 Responsibility for Providing Care and Supervision for Infants, 101170 Criminal Record Clearance and Health & Safety Code 1597.16(a)(1) . Deficiencies are attached on LIC809D. An immediate civil penalty of $500.00 was assessed today for Criminal Record Clearance. Upon receipt, licensee shall post and provide copies of this licensing report to parents/guardians of children in care at the facility and to parents/guardians of children newly enrolled at the facility during the next 12 months. Licensee shall have LIC9224 (Acknowledgement of Receipt) signed and kept in each child's file. Appeal Rights were discussed. The facility representative was provided a copy of their appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days. A notice of site visit was given and must remain posted for 30 days.
