What the inspector wrote

On 10/03/24 at 11:35am, Licensing Program Analyst (LPA) Sarah Garcia conducted a case management- incident visit in response to a self- reported unusual incident report (LIC 624) received on 8/22/24 regarding a child being left unattended. LPA met with Briana Solorio, education manager. A walk through of the facility was conducted, and a census was taken. Total census was 83 preschool children and 8 staff. On 8/22/24 the facility reported to the Department that a child was not left on playground upon classroom coming into the classroom. The facility District Lead viewed video footage of incident and it was seen as the child being in the classroom. After going back and viewing the footage from a different angle and time lapse it was confirmed that Child 1 (C1) did walk in about a minute after the rest of the class. On 8/21/24, LPA received photo evidence of C1 unattended outside in the playground. During today's visit LPA interviewed 4 staff, obtained child supervision records (CSR) for room 6 on 8/21/24, C1's LIC 700, facility incident report form, and 9/9/24 staff training agenda and sign in sheet. Staff 1 (S1) stated, " When I did a playground check again... I believe C1 was hiding behind a pillar. After I closed the door to the playground I did another head count after the scan. C1 was there. It had to be 30 seconds to a minute...I think C1 was hiding behind a pillar while we were counting. It was not an extensive amount of time... " Staff 2 (S2) stated, " They [District Lead] saw the footage and then saw for a second time, and what happened was that C1 was hiding behind a post and another teacher saw C1 alone. The teacher saw C1 from the toddler playground ." Staff 3 (S3), " We went back and checked the footage. We went back through again... they did see that a child (C1) was left on that yard. We self reported a second time. "Staff 4 (S4) stated, " after reviewing the camera again we reported that C1 was left alone outside. " Continued Page 2 Page 2 Based on interviews and record review, on 8/21/24 C1 was left unattended on the outside preschool playground for approximately 30 seconds to a minute. According to Title 22, California Code of Regulations, Section 3, Chapter 4, 101229(a)(1) Responsibility for Providing Care and Supervision, (1) Type A deficiency will be cited today. See attached LIC 809D. LPA Sarah Garcia informed facility representative, Briana Solorio that this report dated 10/03/24 documents (1) Type A citation which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care. Also, LPA Sarah Garcia informed facility representative, Briana Solorio, to provide a copy of this licensing report dated 10/03/24 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. Exit interview was conducted. The Notice of Site Visit was posted. Staff was advised the Notice of Site Visit must be posted for 30 days or $100 Civil Penalty will be assessed. Appeal rights provided. End of Report

C1 was not provided care and supervision during that time. This is an immediate risk to the health and safety, and personal rights risk to children in care.
