What the inspector wrote

On 11/12/24 at 10:45am, Licensing Program Analyst (LPA) Sarah Garcia conducted a case management- incident visit in response to a self- reported unusual incident report (LIC 624) received on 10/28/24 regarding a child being left unattended. LPA met with Jenny Vasquez, director. A walk through of the facility was conducted, and a census was taken. Total census was 88 preschool children and 10 staff. The facility reported that on 10/25/24 at approximately 10:30am-11am as Room 8 was transitioning to the classroom area, Child 1 (C1) stayed outside and ran to the Room 6 door and window area. Staff 1 (S1) and Staff 2(S2) went back inside with Room 8. Staff 3 (S3) in room 6 noticed C1 was outside by the room 6 door area. During today's visit, LPA interviewed 6 staff, obtained child supervision records (CSR) for room 8 on 10/25/24, C1's LIC 700, facility incident report form, parent notification email, and materials and sign in sheet from staff training conducted on 11/11/24. S1 stated that on 10/25/24 during the Room 8 transition from inside to outside they noticed C1 was not inside the classroom and S3 brought C1 back into the classroom. S1 stated the ratio was 24 children and 2 teachers. S2 stated that during transition from outside to inside S2 went back inside to wash the hands and during that time, C1 was brought by S3. S2 stated there must have been 22-24 children and 2 teachers that day. S3 in room 6 stated that they noticed that C1 playing outside of the room 6 door. S3 then noticed that C1 was still outside of the door area. S3 stated there was no one outside so they asked S7 to step into ratio, and S3 brought C1 to classroom 6. S4 in room 6 stated C1 was standing outside the classroom and S3 opened the door and returned C1 to room 8. Continued on Page 2 Page 2 According to 10/25/24 child supervision records (CSR), Room 8 had 21 children with S1 and S2. Based on staff qualifications, S1 is a fully qualified aide and S2 is a fully qualified teacher. Based on interviews and record review, on 10/25/24 Room 8 was operating out of ratio and C1 was left unattended on the outside preschool playground for approximately 1-2 minutes. According to Title 22, California Code of Regulations, Section 3, Chapter 4, 101216.3(b)(A)(1) Teacher-Child Ratio and 101229(a)(1) Responsibility for Providing Care and Supervision, (2) Type A deficiencies will be cited today. See attached LIC 809D. LPA provided Title 22 101216.3 Teacher-Child Ratio regulation for reference. LPA Sarah Garcia informed director, Jenny Vasquez that this report dated 11/12/24 documents (2) Type A citation(s) which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care. Also, LPA Sarah Garcia informed director, Jenny Vasquez to provide a copy of this licensing report dated 11/12/24 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. Exit interview was conducted. The Notice of Site Visit was posted. Staff was advised the Notice of Site Visit must be posted for 30 days or $100 Civil Penalty will be assessed. Appeal rights provided. End of Report

This requirement was not met as evidenced by: Based on interviews and record review, on 10/25/24 at approximately 11am at the time of the incident a fully qualified aide and fully qualified teacher had 21 preschool children. This is an immediate risk to the health, safety, and personal rights risk to the children in care.

  • RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION

    101229 Responsibility for Providing Care and Supervision"(a) The licensee shall provide care and supervision....(1) No child(ren) shall be left without the supervision of a teacher at any time..."This requirement was not met as evidenced by: Based on interviews and record review, S3 found Child 1 (C1) outside by room 6 door area. C1 did not have care and supervision in that period of time. This is an immediate risk to the health, safety, and personal rights risk to chidlren in care.
