What the inspector wrote

On 5/22/2025 at 8:40am, Licensing Program Analyst (LPA) Sarah Garcia conducted an unannounced case management- incident visit in response to a self- reported unusual incident report (LIC 624) received on 4/18/25 regarding a child being left unattended. LPA met with director, Jenny Vasquez. A walk through of the facility was conducted, and a census was taken. Total census was 79 preschool children and 9 staff. A review of staff criminal clearance records on this date 05/22/2025 indicates that all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions. On 04/18/2025, a self-reported Unusual Incident Report (UIR) was filed with the Licensing Office. On 4/17/24 the facility reported that Staff 3 (S3) was in the restroom changing diapers when Child 1 (C1) wandered to room 6 at 9:53am. Room 6 was empty at that time. At 9:58am Staff 1 (S1) comes inside room 6 returning from outdoor time and sees C1 alone in the classroom. Then C1 runs back to the bathroom. The bathroom is connected to room 5 and 6 and both classes have access to the bathroom. C1's parents were notified about the incident. The director notified the district manager, and district manager confirmed via footage that C1 walked into room 6 by themselves. During today's visit, LPA interviewed 4 staff, 1 child, and obtained child supervision records (CSR) for room 5 on 4/17/25, C1's LIC 700, and 4/28/25 training agenda. LPA took photographs of the location of the incident. Continued on Page 2 Page 2 All staff interviewed stated C1 was found in room 6 by S1 who was returning from outdoor play time with their classroom. C1 was not qualified for interview. Based on LPAs interviews and record review, Child 1 (C1) was found in room 6 by themselves by Staff 1 (S1). C1 was not provided care and supervision during that time . According to Title 22, California Code of Regulations, Section 3, Chapter 4, 101229(a)(1) Responsibility for Providing Care and Supervision, (1) Type A deficiency will be cited today. See attached LIC 809D. LPA Sarah Garcia informed director, Jenny Vasquez that this report dated 5/22/25 documents (1) Type A citation which shall be posted for 30 consecutive days as there are immediate risk(s) to the health, safety, or personal rights of children in care. Also, LPA Sarah Garcia informed director, Jenny Vasquez to provide a copy of this licensing report dated 05/22/25 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. An exit interview conducted with director, Jenny Vasquez. Notice of Site Visit was provided and must be posted for 30 consecutive days.

C1 was not provided care and supervision during that time. This is an immediate risk to the health and safety, and personal rights of children in care.
