What the inspector wrote

(Page 2) During the investigation, LPA Garcia interviewed 19 staff, 5 parents, reviewed relevant documentation, facility roster, and personnel report. During staff interviews on 6/4/24, Staff 1 (S1), Staff 2 (S2), Staff 3 (S3), Staff 4 (S4), Staff 5 (S5), Staff 8 (S8), Staff 9 (S9), Staff 16 (S16), Staff 17 (S17) made no disclosures regarding the allegations. LPA asked Staff 6 (S6) if you or any staff yelled and S6 stated, \342\200\234Yeah, I have. It is toward the classroom and not in one specific classroom. It is when the kids are running around the classroom. That was two weeks ago, and [they] got everybody and said that is very unsafe for your bodies\342\200\246.It was classroom control.\342\200\235 Staff 7 stated, \342\200\234The over-the-top yelling is a lot sometimes. It is never effective to be yelling at the kids if they are not acting a certain way. I have heard a teacher threaten no outside time for a child because they were acting up.\342\200\235 Staff 10 (S10) stated, \342\200\234It is an attention-grabbing yell not yelling at children.\342\200\235 Staff 11 (S11) stated, \342\200\234I had a situation, but it was a year ago and it was about tone. They were not rude it was about tone. It was 5-6 years ago. One thing we talked about in staff meetings was tone and meanings...I do have teachers I can hear talking from here... It is not harsh tones that I hear.\342\200\235 S12 stated, \342\200\234I guess I would say in an instance where they would put themselves in danger. If someone was climbing a chair, we would yell their name.\342\200\235 Staff 13 (S13) stated, \342\200\234Yes, in the sense that I would not call it is yelling. A voice that comes out and that teacher voice comes out. An example a child that might be biting another child and they do not have time to put their body in front. It is a raise teacher voice for the safety of the child. It could look and sound like it is a raised voice.\342\200\235 Staff 14 (S14) stated,\342\200\235 No, I don\342\200\231t feel like we yell. We have a strict, firm voice but never yelling.\342\200\235 Staff 15 (S15) stated, \342\200\234No, I don\342\200\231t think so. We are all good. We raise our voice sometimes....it is a lot of redirections...\342\200\235 Staff 18 (S18) stated, \342\200\234Not in a way it was yelling. If anything, it was for their own safety. Some of our kids like to climb boxes or furniture. We raise our voices to tell them not to. If the hid....\342\200\235 Staff 19 (S19) stated, \342\200\234One of the staff left not too long ago. She was the one who was verbally abusing the children in her classroom. She had specific names for her children\342\200\246\342\200\235 S7 stated, \342\200\234S1. They are no longer working here, and they were the lead teacher in that classroom.\342\200\235 (continue to page 3) (Page 3) LPA Garcia contacted 5 parents. 3 out of 5 parents made no disclosures about the allegations. Based on LPA\342\200\231s staff interviews, there is an insufficient amount of evidence to corroborate the allegations that staff yell at daycare children and staff spoke inappropriately to daycare children. Although the allegation(s) may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation(s) did or did not occur, therefore, the above allegation(s) are found to be UNSUBSTANTIATED. Exit interview conducted and report was reviewed with the education manager, Briana Solario. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. Appeal Rights were explained. Education manager, Briana Solario was provided a copy of appeal rights (LIC 9058 01/16) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days. First level appeals should be sent to the regional manager to the address listed above. End of Report

Facility reported the HFM outbreak during the 10-day initial visit on 7/3/24. This is a potential health and safety risk to the children in care.

    101218.1 Admission Procedures and Parental and Authorized Representative's Rights (a) In accordance with the child care center's....(2) procedures, activities, services...(B) procedures...should the child become ill...This requirement was not met as evidenced by: Based on interviews and record review, the facility did not follow admission protocol by accepting children with illness and not utilizing an isolation area during the HFM outbreak between 6/3/24-7/30/24. This is a potential health and safety risk to the children in care.

    101226.1 Daily Inspection for Illness(a) The licensee shall be responsible for ensuring that children with obvious symptoms of illness including, but not limited to, fever or vomiting, are not accepted.This requirement was not met as evidenced by: Based on interviews and record review, on 7/12/24, LPA received report of an infant vomiting on 7/11/24 at approximately 3:00pm. Based on review of sign in and sign out sheets, the infant returned to the facility on 7/12/24 at 9:26am. This is an immediate health and safety risk to the children in care.

    101426.2 Infant Care Isolation for Illness (b) The isolation area shall be equipped with a crib, cot, mat or playpen for each ill infant.This requirement was not met as evidenced by: Based on interviews and record review, facility did not isolate infants showing signs of illness to an isolation area during the HFM outbreak between 6/3/24-7/30/24. This is an immediate health and safety risk to the children in care.
