What the inspector wrote

Page 1 of 2 Licensing Program Analyst (LPA), Mahnaz (Nancy) Malek conducted an onsite case management inspection for the purpose of investigating an incident that the facility self reported to our office on 12/11/2025. LPA met with assistant director, Marsha Aranda. The director Shannon Valdez arrived during LPA's inspection. LPA took census. There were a total of 10 infants and toddlers in two different rooms. There were two awake infants with one staff in the infant room, and there were 8 napping toddlers with one staff in the toddler room. A review of the Facility Personnel Report Summary on this date indicates all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions. According to the self incident report, on 12/11/2025 the facility representative received an anonymous telephone call from a bypasser on the street reporting that it was observed and heard a child crying and saw a staff member pick up the crying child and placed the child down harshly. The playground is viewed from outside through the fences. Today LPA interviewed seven staff including Staff # (S1) who was involved in the incident. S1 stated that S1 was outside with 4 toddlers transitioning to the toddler playground. S1 helped the toddlers to sit outside during transitioning from inside the classroom to outside. S1 stated a 17 months old Child # 1 (C1) started Continued on page 2 Page 2 of 2 crying when children were told to sit. C1 was hanging to the gate and did not want to move from the gate. S1 stated S1 helped C1 to sit by holding their hands instructing them to sit gently so S1 could conduct name to face procedure. S1 stated S1 did not have any intention to hurt any child. It was a misunderstanding of the situation the way it was observed. S1 stated S1 loves children and cares for them. LPA interviewed the other 6 staff that might have had information regarding the incidents. S2, S3, S4, S5, S6, and S7 stated that they did not observe this particular incident. They all stated that they had not observed any staff members to be harsh and aggressive with children. They stated there are times that they have to stop toddlers of a dangerous situation and hold them or pick them up quickly but they have never observed any aggressive behavior from any staff members towards toddlers. Based on the interviews with 7 staff including S1, there is no witness or evidence to prove the reported incident from the anonymous bypasser happened or did not happen. In the areas that were evaluated, no deficiency was cited of the California Code of Regulations, Title 22, Division 12 on today's investigation regarding the incident. Shannon Valdez, the director was informed that the \342\200\234Notice of Site Visit\342\200\235 must be posted for 30 consecutive days. The \342\200\234Notice of Site Visit\342\200\235 must be posted on or adjacent to the door. Failure to post will result in Civil Penalties of $100.00. The director, Shannon Valdez was provided with a copy of their appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days. The exit interview was conducted with director, Shannon Valdez. End of report.
