What the inspector wrote

During the course of the investigation, LPA Torrence interviewed seven staff members. All seven interviewed staff stated they understood what the ratio should be in each classroom. Staff 2 (S2) disclosed witnessing the classroom out of ratio. S2 stated being alone with 14 children. S2 stated staff coming in late makes the classroom out of ratio. Staff 4 (S4) disclosed witnessing classroom out of ratio between 7:45 a.m.-8:30 a.m. and have seen it a couple of times. Staff 7 (S7) disclosed the classroom would be out of ratio for a few minutes when parents drop off, and at that time S7 is trying to get another teacher in the classroom. Staff 3 and Staff 5 stated other staff members have complained to them that the opening classroom is usually out of ratio. During the course of the investigation, LPA Torrence reviewed random dates of staff sign in/out sheets for staff and parents, and it was discovered that on 08/29/2022 there was one staff present with 17 preschool children between 6:30 a.m.-8:30 a.m. causing the classroom to be out of ratio. LPA Torrence contacted four parents. Interviewed parents had no issues or concerns. Based on LPAs interviews and records review the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. California Code of Regulations, Title 22, Division 12 & Chapter 1, 101216.3(a) Teacher-Child Ratio is being cited on the attached LIC9099D. Exit interview was conducted. The Notice of Site Visit was posted. Appeal Rights was explained. A copy of appeal rights (LIC 9058 1/16) will be provided through email and their signatures on this form acknowledges receipt of these rights. First level appeal is to Regional Manager, address is above on the report. If the facility receives a Type A violation, the licensee shall post and provide copies of the report to parents/guardians of the children in care at the facility by the next business day and shall provide to the parents/guardians of children newly enrolled at the facility during the next 12 months. In addition, the licensee shall immediately post upon receipt the Proof of Correction for 30 consecutive days and provide a copy to current and enrolling parents. The licensee is to keep Acknowledgement Receipt (LIC 9224) signed by parents in each child\342\200\231s file. In addition, the licensee shall immediately post upon receipt the Proof of Correction for 30 consecutive days.
