What the inspector wrote

Page 2 On 07/25/2025, the Orange County Child Care Office received a complaint alleging: 1) Lack of supervision resulting in day care child sustaining injuries. 2) Staff hit day care child. The Reporting Party (RP) stated that 4 (four) incidents happened at the day care regarding a child (C1) and that staff provided incident reports but believed that staff are responsible for child injuries. RP also stated a staff member hit a child\342\200\231s head and the RP did not know the staff name. During the investigation, LPA toured the facility on 07/29/2025, 09/02/2025, 09/23/2025, conducted 10 (ten) staff (S1-S10) interviews, and attempted to interview 3 (three) children (C2-C4) and 1 (one) of 3 (three) children qualified to be interviewed. LPA obtained Personnel Report, School Roster, Daily Schedule, Police Report dated 7/25/2025, 4 (four) incident reports for C1 dated 07/01/2025, 07/03/2025, 07/09/2025, and 07/24/2025. Regarding allegation \342\200\234Lack of supervision resulting in daycare child sustaining injuries.\342\200\235: On 07/29/2025, 09/02/2025, and 09/23/2025 visits LPA toured the classrooms and observed teachers engaged with children supporting them during playground time, classroom time, and napping. 9 (ten) of 10 (ten) staff interviewed stated that they provide supervision to children by providing a safe environment for children, position them self where they can see the children and still provide support, walk around the classroom or playground and to know what children are doing, engage with children, provide activities for children, follow a schedule, and know how many children are in the classroom. LPA obtained KinderCare Daily Schedule with times listed to support daily activities during the day. 10 (ten) of 10 (ten) staff interviewed stated that when a child is injured at school that they will assess the injury/incident, provide first aid, report to administration, and call parents if needed. 10 (ten) staff interviewed stated when children bite at school that an incident report is written for all children involved, parents are called, and that parents/staff sign the report. 3 (three) staff interviewed stated they knew of incidents regarding C1 being bitten and having a bloody nose. LPA obtained incident reports for C1 dated 07/01/2025, 07/03/2025, 07/09/2025, and 07/24/2025 with documented information pertaining to the incidents, action taken, and staff/parent signatures. During LPA review of Family Handbook on page 18 Biting states \342\200\234 If your child bites or is bitten, you and the family of the other child involved will receive an Incident/Accident Report that keeps the identity of both children confidential. If you have any concerns regarding a biting incident, please talk to your child\342\200\231s teacher or your Center Director.\342\200\235 1 (one) interviewed staff stated they will provide support to a child by using a behavior chart (ABC Chart )to help support the child displaying the behavior, and parents will sign the chart, provide extra support to the child to prevent the behavior, and provide safe activities for the child. Continue to page 3. Page 3 Regarding allegation \342\200\234Staff hit day care child\342\200\235: On 07/29/2025, 09/02/2025, and 09/23/2025 during visits LPA toured the classrooms and playground, observed staff supporting and engaged with children during playground time, classroom time, and napping. 10 (ten) of 10 (ten) staff interviewed stated they have never witnessed a staff member hitting a child or violating a child\342\200\231s personal rights. 10 (ten) of 10 (ten) staff members stated that they are child mandated reporters and if they would witness a child being abused that they would report it. On 10/06/2025, LPA conducted parent interviews. LPA called 4 parents, and LPA was able to interview 1. The 1 parent interviewed did not divulge any information pertaining to the allegations. 1 (one) of 3 (three) children qualified to be interviewed and did not disclose any information pertaining to the allegations. Based on LPA observations, interviews, and records review; the preponderance of evidence standard has not been met. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations of: Lack of supervision resulting in day care child sustaining injuries. Staff hit day care child did or did not occur; therefore, the allegations are UNSUBSTANTIATED. During the course of investigation, it was determined that on July 25, 2025, a Fountain Valley police officer visited the facility regarding a reported incident that happened to C1. During records review of police report, LPA observed that Fountain Valley police department declared no crime has occurred and that the injuries pertaining to C1 were from playing with other children. The facility failed to report the incident to the Department by telephone or fax the Department\342\200\231s next working day and during its normal business hours. California Code of Regulations, Title 22, Chapter 1 101212 Reporting Requirements is being cited on the attached LIC9099D. Please refer to attached 9099D for documentation of deficiencies. Exit interview conducted and report was reviewed with Director DIrector-Zelinda, Zazuetta. The director was informed that the \342\200\234Notice of Site Visit\342\200\235 must be posted on or adjacent to the door for 30 days. Failure to post will result in a Civil Penalty of a $100.00.
