What the inspector wrote

*This is an amended document* The adult #1 (A1) stated that in their time at the facility, they recall staff at the facility being disrespectful to them, and at times condescending when referring to the children's behavior in front of children. A1 stated that yelling was not done at children, nor were children ridiculed to the point of the personal rights being violated. LPA intervi ewed six parents on 3/25/21 and 3/29/21. Parents stated that they were not witness to the facility violating the children's personal rights, and had generally positive responses for their experience with the facility. LPA also interviewed eleven children on 3/9/21 and 3/30/21. From the information obtained from the children interviews, it was not determined that the facility had violated the personal rights of children related to the allegations. There was insufficient information to create a preponderance of evidence to support either three of these allegations. Some children did state that there may have been an occurrence where a staff became potentially aggressive, but this did not reach the threshold of violating the personal rights regulations. Based on all this information the preponderance of evidence standard for these three allegations was not met, therefore the above allegations are found to be unsubstantiated. From all of the available information obtained by LPA during the course of the investigation, that there is insufficient evidence indicating that the staff yells at daycare children, demonstrates inappropriate form of punishments towards daycare child/ren, or became aggressive towards children. Although the allegations may have happened or is valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur; therefore the allegations are unsubstantiated. Exit interview was conducted, and report was reviewed and discussed. Notice of Site Visit was posted during the visit. The facility representative was informed that the Notice of Site Visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100 per day. The licensee was provided a copy of their appeal rights (LIC 9058 12/15) and their signature on this form acknowledges receipt of these rights.
