What the inspector wrote

*This is an amended report. On 9/17/2024, at 9:35AM Licensing Program Analyst (LPA) Karen Navar conducted an unannounced case management incident inspection in response to a self-report Unusual Incident dated 8/20/2024. LPA met with Director Mojan, Vasseghi and toured the facility. LPA observed 45 preschool children and 19 infants along with 11 staff. A review of staff criminal clearance records on this date indicates that all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions. On 8/20/2024 a self-reported Unusual Incident Report (UIR) was filed with the Licensing Office. The facility reported on 8/20/2024, that Staff (S1) saw Staff 2(S2) kiss a child on the mouth. Staff (S3) stated that S2 was sent home until further investigation. S3 interviewed staff and stated Staff 4 (S4) and Staff 5 (S5) did not see anything and that S2 normally will kiss a child on the head and hold their face with two hands. On 9/17/2024, at 9:40AM during tour, LPA observed 5 staff and 19 children outside playing on the playground. LPA interviewed 3 staff and and reviewed staff handbook. Staff S1-S2 stated that they do not recall the incident. S2 stated that out of love they would naturally kiss the head, hands, or cheek. S4 stated they have met with staff regarding personal rights of infants and children. Infants did not qualify to be interviewed. Based on LPA observation from the staff handbook and interviews there was not enough evidence to determine violation of personal rights. No deficiencies were observed of the California Code of Regulations, Title 22, Division 12 at the time of the visit. Exit interview conducted and report was reviewed with Mojgan, Vasseghi. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
