On 05/30/2025, the Orange County Child Care Office received a complaint alleging: 1) Staff interacted with children inappropriately. The Reporting Party (RP) stated the students were lined up to get on the bus and upon entering the bus, that C7 had approached S1 and S1 interacted with child inappropriately.
During the investigation, the LPA toured the facility on 06/04/2025, 7/07/2025, conducted records review for C1-C4, reviewed Driver Safety Training certificates for eight (8) staff, took photos inside/outside of bus, obtained a copy of KinderCare Personnel Report, Children’s Roster, School age Roll Call Sheet for June 8th-June14th,2025, Van Runs Fall 2024, Bus Child Supervision Record 5/27/2025, copies of KinderCare Enrollment Forms.
LPA interviewed three (3) staff members (S1-S3), and one interviewed staff stated they do not work with school age. LPA attempted to interview four (4) children (C1, C4-C6). Two (2) of the four (4) children qualified to be interviewed. LPA called 5 parents to interview, LPA was not able to reach the parents and left a voicemail for parents to call back.
On 06/04/2025, 7/07/2025 LPA conducted two (2) staff interviews (S1-S2) who stated that personal rights of a child are that we respect the child and do not touch the child. Both staff interviewed stated that when children arrive at the bus
some children will be greeted by staff, check the children in on the Bus Child Supervision Record, and then the children will pick their seat and put their seat belt on. S1 stated that children were excited to see S1 when S1 arrives and that when children were greeted by S1, on occasions, there were physical contacts such as be a touch such as a kiss or a hug in a non-sexual way but caring and welcoming just a greeting, and S1 had never had any parent concerns regarding physical contacts with the children. During children’s interviews, all interviewed children did not divulge any concerns related to the allegation.

Based on information gathered from staff interviews, the preponderance of evidence has been met; therefore, the allegation of, Staff interacted with children inappropriately is substantiated. California Code of Regulations, Title 22, Division 12, Chapter 1 Section 101223 (a)(1) Personal Rights are being cited. See LIC9099D for deficiency cited.
Exit interview conducted and report was reviewed with Director Mojgan, Vasseghi. The Director was informed that the “Notice of Site Visit” must be posted on or adjacent to the door for 30 days. Failure to post will result in a Civil Penalty of a $100.00.

On 05/30/2025, the Orange County Child Care Office received a complaint alleging: (1) Staff did not pick up the daycare children from school on time, and (2) Staff roughly handled children. The Reporting Party (RP) stated there were times that the bus was late and RP witnessed an incident, in which, Staff #1 (S1) was holding Child #2 (C2)’s wrist up as they were walking C2 to their seat and then lifted C2 up by the wrist to place C2 on the seat of the bus.

Regarding allegation, “Staff did not pick up the day care children from school on time.” During facility visits on 6/04/2025, LPA conducted a records review and reviewed enrollment forms for C1-C4. Records review showed a transportation agreement on file with a start time of 8:00AM, end time at 2:20PM, and minimum day time for C2 at 12:40PM. During staff interviews S1 stated that S1 regularly arrives at the school M-F at 2:20PM to pick up the children and that the children get on the bus at about 2:35PM. S1 shared that on occasions when there was a line of buses at the school to pick up children, this can cause a delay in pick-up but we are at the school. S1 stated that if they would ever run late/ but it rarely happens the procedure is for staff to call the school to inform them, and the school would either take the children to the office or wait with the children until S1 arrived. LPA reviewed a document titled Van Runs Fall 2024 schedule that had times listed as 8:00AM-2:20PM M-F, Wednesday 8:00AM-12:20PM. 2 (two) qualified children interviewed did not divulge any information pertaining to this allegation.

Regarding allegation “Staff roughly handled children.” During facility visits on 6/04/2025, 7/07/2025. LPA interviewed S1 who stated that they heard of a phone call that took place with S2, the person stated they were calling from Trabuco Mesa Elementary, and that the person had mentioned that a elementary staff member witnessed a child on the bus being handled wrong. During S2 interview with LPA, S2 stated the person calling had said that someone had reported to them that the bus driver had placed a child in a seat on the bus in a rough manner. #2 (two) staff interviewed stated that the caller did not leave their name, the date of the incident, and did not describe in detail how the child was placed in the seat in a rough manner, and that they did not contact KinderCare again to follow up with the incident. During the facility inspection on 6/04/2025 LPA observed the bus used to pick up children from Trabuco Mesa Elementary and there were no obstacles during inspection the bus doors opened, stairs were accessible, center aisle was clear, the view from inside the bus to outside was clear, seats were low enough for children to access, and were in good condition on this date.
During staff interviews #2 (two) staff stated that when children arrive at the bus that they will come up the stairs, some children will greet them, they check them in on the Bus Child Supervision Record, and then the child will pick their seat and put their seat belt on. #2 (two) staff interviewed stated that the seats on the bus are low, and that children usually do not need assistance with getting up on the seat. #2 (two) staff interviewed stated that children on the bus have pretty good behavior and that they have never handled or witnessed a staff pick up a child by the wrist to place them on a seat and that if there are children who cannot sit next to each other very well they would sit on a different seat, but this rarely happens. #2 staff interviewed stated that once children are checked in and seated, they do a safety check for seat belts to make sure all children are buckled up. S1 stated that staff take Driver Safety Training and LPA reviewed Driver Safety certificates for 8 (eight) staff. During LPA interviews with C4 and C5, C4 stated that that they take the bus and that they know how to sit down and use the seat belt and will help other friends. C4 stated that everyone knows how to sit down and doesn’t need help, there are no little kids on the bus. C5 stated that the bus arrives at the school, the bus driver says good afternoon, writes down the names and if the child is not there, they call the office, that kids go up the stairs on the bus by themselves and can use the handle, children pick their own seats and everyone knows how to get on their seats but some little kids need help with seat belts, and the driver makes sure the seat belts are secure.

During interviews, all interviewed staff denied handling the children roughly. All interviewed staff/adult 1 stated they have not witnessed any staff handling the children roughly. All interviewed staff stated they followed safety procedures including ensuring the children wore their seat belts appropriately and accounted for each present child in the bus on the Bus Child Supervision Record. Interviewed children did not disclose any concerns related to the allegation and denied witnessing any staff handling the children roughly.
Based on LPA observations, interviews, and records review; Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations of; Staff did not pick up the day care children from school on time. Staff roughly handled children did or did not occur; therefore, the allegations are UNSUBSTANTIATED.
Exit interview conducted and report was reviewed with Director Mojgan, Vasseghi. The Director was informed that the “Notice of Site Visit” must be posted on or adjacent to the door for 30 days. Failure to post will result in a Civil Penalty of a $100.00.
