What the inspector wrote

On 03/06/2023 Licensing Program Analysts (LPA), Dianna Valdez Santana and Archibaldo Silva conducted an on site visit for the purpose of a 1 year required inspection. LPAs and Director, Janine Ceballos toured the facility inside and outside and the floor and yard plan (LIC 999) were verified. Census was taken in individual classrooms. The overall census observed was 6 preschool staff and 39 preschool children. During the inspection it was determined the facility is operating within its licensed capacity and within compliance of staffing ratios. Facility hours are Monday through Friday 7:00 AM - 6:00 PM . Entrance checklist (LIC 125) provided to the director upon arrival. A review of the Facility Personnel Report Summary on this date indicates all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions with the exception of Maria Del Rosio Morales. According to Director, her exemption request is pending. She has been working as a teacher at the facility since 3/15/2022. LPA observed Maria caring for 17 children along with 2 other staff present on the outside play area at 11:30 AM. Licensee was reminded that all adults 18 and over, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated. During the inspection of the indoor activity space, items which could pose a danger to children (detergents, cleaning compounds, and medications) were observed to be stored out of the reach of children. Poisons/Hazardous Items are kept in the janitor\342\200\231s closet. The children bring lunch from home and is stored in their individual classroom. Snacks are provided by the facility. Food prep areas were clean and sanitary. Page 1 of 5 Food is properly stored. Menus were posted where they could be reviewed by parents. Floors, equipment, and furniture were clean and were observed to be in good repair and free of sharp edges. There is drinking water available to children indoors by water cooler and the children have their individual sports bottled with their name labeled on it. The children's bathrooms are clean and sanitary. Children nap on cots, and bedding is stored individually and is taken home weekly to be washed by parents at end of week. The facility has conducted an emergency drill within the past six months. The facility has a working carbon monoxide detector and fire extinguisher. Facility met all posting requirement. The California Child Passenger Safety Law was posted by the entrance of the facility. The outdoor activity space was inspected for compliance. The playground was enclosed by a fence at least four feet in height. The surface of the outdoor activity space was well maintained and free of hazards. The cushioning material, rubber flooring around the climbing slides and other similar equipment appeared to be enough to absorbs falls. Drinking water in the outdoor activity space is provided by water cooler with disposable cups. The outdoor equipment and toys were in good repair and free of sharp edges. There are no bodies of water present at the facility. The facility grounds were safe, sanitary and in good repair. Staff files were reviewed for staff present during the facility inspection on this date, 05 out of 11 staff files were reviewed. Health screening and immunization's as required were reviewed. Beginning September 1, 2016, Health and Safety (H&S) 1596.7995 states, a person shall not be employed or volunteer at a day care center if he or she has not been immunized against influenza, pertussis, and measles. Proof of immunization against pertussis, measles for the staff were reviewed and within compliance. All staff files have the influenza vaccine or written declaration to decline Beginning March 31, 2018, H&S Code 1596.8662 requires all licensed child care providers, administrators, or employees of a licensed child day care facility to complete the mandated reporter training , and to renew the training every two years. . At least one staff member present possesses current EMSA approved Pediatric CPR/First Aid certifications, which expires 02/20/202. Page 2 of 5 Incidental Medical Services (IMS) policy was discussed. For IMS information see Evaluator Manual - Regulation Interpretations and Procedures for Child Care Centers Sections 101173 and 101226. When any IMS is provided, an updated Plan of Operation that includes IMS must be submitted to the Department. The director was informed, and website given, about the California Child Care Disaster Plan has been posted to the UCSF California Childcare Health Program website: cchp.ucsf.edu/content/disaster-preparedness Also provided was information about the E-Learning Modules available at https://ccld.childcarevideos.org A copy of the California Department of Social Services Lead Information Brochure was explained and provided to the facility representative. https://www.cdss.ca.gov/Portals/9/CCLD/PINs/2022/CCP/PIN-22-06-CCP.pdf Facility Director does have lead training Certificate. Safe Sleep Consultation provided with the director during today's visit. . LPA discussed the safe sleep regulations with the director and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed the director of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. Page 3 of 5 Safe to Sleep Campaign: https://safetosleep.nichd.nih.gov/materials \302\267 Always place infants on their backs for sleeping \302\267 Use only a tight-fitting sheet on the crib or play yard mattress \302\267 Do not hang any items from the crib or above the crib \302\267 Keep all items, including blankets, out of the crib or play yard \302\267 Pacifiers may be used as long as they do not have items attached to them \302\267 Infants should not be swaddled or have any items covering them while sleeping \302\267 The temperature of the room should be comfortable enough for an adult to wear a t-shirt and not be too hot or too cold. LPA, Valdez Santana was available to answer any questions about Safe Sleep that was discussed today. the director stated that she has no questions during today\342\200\231s consultation. Director was informed of the Child Care licensing webinars and to review PIN 22-30-CCP for more information on how to access the Webinars on On March 28. 2023 at 6:00 PM Resources: https://ccld.childcarevideos.org/family-child-care-providers/ Staff interview conducted with the director during today\342\200\231s inspection. In the areas that were evaluated, Staff Records - Type A: 101170(e) deficiency was observed of the California Code of Regulations, Title 22, Division 12 at the time of the visit. Page 4 of 5 LPA Valdez Santana informed Director that this report dated 3/6/2023 document(s) one Type A citation which shall be posted for 30 consecutive days as there is immediate risk to the health, safety, or personal rights of children in care. Also, LPAs informed the Director to provide a copy of this licensing report dated 3/6/2023 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. Exit interview conducted and report was reviewed with the director, Janine Ceballos Appeal Rights and deficiencies were discussed. The facility representative was provided a copy of their appeal rights (LIC 9058 ) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
