What the inspector wrote

On 06/16/2021 Licensing Program Analyst (LPA) Corral received an Unusual Incident Report (UIR) which was self-reported to our office by Licensee Jennifer de Leon. LPA Corral conducted an on-site inspection to investigate the incident. Upon entrance LPA Corral meet with Director Griselda Veronica Tapia. There were 18 preschool children present in care with 2 teachers providing care and supervision. Due to COVID 19 Guidelines, LPA Corral observed Director and staff members wearing face masks, social distancing and following CDC and Dept of Public Health Guidelines. During the inspection it was determined the facility is operating within its licensed capacity and within compliance of staffing ratio s. Facility hours are Monday – Friday, 6:30 a.m.- 6p.m. A review of the Facility Personnel Report Summary conducted on 06/23/2021 indicates all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions. According to the self-report incident sent to our office, a staff member (S1) grabbed a 4-year-old child’s shoulder. The UIR received states that when Director spoke to Child’s Mother, there was a bruise on Child’s shoulder, it was not clarified whether it was the left or the right shoulder. Director Veronica spoke to Child on 06/03/2021 and a bruise or marks were not observed. When Director spoke to child (C1), child did tell Director that S1 grabbed his shoulder on the playground. Director spoke to an additional teacher (S2) and she stated she did not witness any Staff grab C1’s shoulder. Director stated in the UIR that C1 returned to care for an additional week but then discontinued care almost 2 weeks later. LPA Corral interviewed Child’s mother on 06/22/2021. Mother stated her child disclosed to her that his shoulder was squeezed by S1. Mother stated S1 informed her that she grabbed her child’s arm not shoulder but did not squeeze it. LPA Corral also interviewed S1 on 06/24/2021, S1 stated C1 was playing in the playground. S1 spoke to C1 and asked C1 to keep his hands to himself. Child was told he would go on quiet time. S1 stated she grabbed C1’s arm not shoulder. Continue to Page 2. Page 2. S1 clarified she did not squeeze C1’s shoulder but grabbed child by the arm to take Child to quiet time. C1 sat down for four minutes and had quiet time then returned to play with the other children. Due to the information that was obtained during the Director, Teacher and Parent Interviews, no citation is being issued during today’s inspection. LPA Corral conducted an Exit Interview with Director. Notice of Site Visit was provided and posted by Director. Director was informed the Notice of Site Visit must be posted for 30 consecutive days and failure to post will result in a Civil Penalty of $100.00. The report was read reviewed and discussed to Director. Appeal Rights were explained, Director was provided a copy of their Appeal Rights (LIC 9058) and signature on this form acknowledges receipt of these rights. Director was informed all appeals must be in writing and received by the Regional Office within 15 business days. End of Report.
