page 2 In reference to the allegation that Staff leave day care children soiled for an extended period of time resulting in diaper rash. LPA interviewed five staff who all denied leaving children soiled for an extended period of time. All five staff indicated that they check children every 1.5 to 2 hours and change pull ups as often as necessary. One staff indicated they have check children hourly because all children come at different hours. LPA was advised that there are no children with diapers in this program. Director stated that they do not document the changes in pull ups but she has not received any complaints or concerns from parents. LPA interviewed four out of ten parents who had returned LPAs calls and none divulged any information regarding this allegation. LPA interviewed seven children but none could provide information regarding this allegation. LPA Rivas was unable to corroborate the allegation that the facility leaves children soiled for an extended period of time resulting in diaper rash. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is unsubstantiated . In reference to the allegation that facility does not have adequate staffing to care and supervise day care children; An unannounced visits were conducted on 07/19/23, 08/08/23 and 08/10/23 and at each visit facility was operating within it's licensed capacity, including ratios. Director reports that in the morning she has one staff open for the infant license#304270547 and one for this license .Director further reports she has a floater who can flex her schedule who can be at the facility within 5 minutes. Interview with four other staff indicated they are all within ratio. All staff interviewed denied having only one staff and 20 children. Interview with one staff indicated s/he is a floater and his/her schedule is flexible and s/he can be at facility within 5 minutes. All staff interviewed were aware of ratios. All 7 children interviewed did not provide information regarding this allegation. All 7 children stated there is always a lot of teachers. LPA Rivas was unable to corroborate the allegation that the facility does not have adequate staffing to care and supervise day care children. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is unsubstantiated. In reference to the allegation that Child was yelled at by staff; LPA interviewed seven children all denied that staff yelled at children in care. LPA interviewed five staff who all denied yelling at children. All five staff indicated that voices have been raised in order to protect the health and safety of children in care. One example was given; During snack time all preschool children were seated, staff turned to get napkins and did page 3 not see a child sitting in chair and automatically yelled out their name because staff believed they had gone outside without supervision. Staff further stated this was an automatic response as child tended to want to leave area unsupervised. Staff further stated during this incident only child's name was verbalized. All staff denied yelling at children in a form to violate their personal rights. All staff interviewed denied hearing another staff yell at children. LPA Rivas was unable to corroborate the allegation that Child was yelled at by staff. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is unsubstantiated. An exit interview was conducted with Licensee Jennifer Guidry De Leon. Appeal Rights were explained. The Director was provided a copy of appeal rights (LIC 9058) 01/16) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days. First level appeals should be sent to the Regional Manager to the address listed. The Notice of Site Visit was given and discussed it must be posted as required by H & S Code Sec. 1596.817. Notice of Site Visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100.00.
