page 2 On 07/18/23 the Regional Office received a complaint alleging that facility is co-mingling infants and preschool children and facility is not operating within ratios and that there are up to 20 children with only one staff. The investigation consisted of interviews with four staff and four parents (who returned LPAs call), review of facility records, physical plant tour on 07/19/23 and 08/10/23 by LPA Rivas and an annual inspection conducted on 08/08/23 by LPA N Tran. In reference to the allegation that children are co-mingled infants with pre school children. The following was found; This facility is on the same property, same address as the pre school under license#304270545. There are four buildings on the property. The building that houses the infant license also has a classroom designated for two year olds. The 2 yr old classroom is separated by a door and walls which are under license 304270545. LPA was advised and observed the sign in and out procedure for the infant license. At 7:17 am LPA observed parent signing in their infant in the building under license#304270545 and then walk their child to the front door of the infant license. All this is done without leaving the property. The sign in and out area is in a general common area. Interview with four staff indicated children are not co-mingled. Interviews with four staff indicated that there is a separate teacher, and separate room that is used for the 2 year olds. However, due to summer hours the room is not in use. LPA had observed that the room in question was not in use during LPA's visits. Interviews with four out of ten parents who responded did not divulge any information regarding this allegation. LPA Rivas was unable to corroborate the allegation that the facility co-mingles infants and pre school children. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is unsubstantiated . In reference to the allegation that the facility is operating out of ratio the following was found: A visit was conducted on 07/19/23 by LPA Rivas and on 08/08/23 by LPA Tran and today by LPA Rivas. At each visit it was found facility was operating within it's licensed capacity. LPA, Rivas interviewed four staff who indicated that they are always in ratio. Licensee reports she changes schedules to accommodate the drop offs and pick up times. LPA interview with four out of ten parents did not divulge any information regarding this allegation. cont page 3 page 3 .LPA Rivas was unable to corroborate the allegation that the facility is operating outside it's license. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is unsubstantiated . An exit interview was conducted with Licensee Jennifer Guidry De Leon. Appeal Rights were explained. The Director was provided a copy of appeal rights (LIC 9058) 01/16) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days. First level appeals should be sent to the Regional Manager to the address listed. The Notice of Site Visit was given and discussed it must be posted as required by H & S Code Sec. 1596.817. Notice of Site Visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100.00.
