What the inspector wrote

Page 2 The complainant alleged daycare child was hit while in care. On 1/31/22, LPA interviewed Child 1(C1) and Parent 1 (P1). According to P1, sometime in November 2021, C1 came home and said somebody hit her. P1 noticed a small mark on C1\342\200\231s arm. LPA attempted to interview C1 on 2/25/22, however LPA was unable to qualify C1 due to limited verbal communication. On 12/17/21 and 3/07/22, LPA interviewed 4 staff including the director. According to the director, P1 came to school and asked about C1 being hit by a ruler. Director states they do not have a ruler at school and will speak with Staff 2(S2). S2 states she spoke with P1 and informed did not witness C1 hit by a ruler nor this incident took place. According to the director, staff are all trained in personal rights. There was no disclosure from the 2 staff. On 1/31/22, LPA called 11 parents of which 5 of the 11 were interviewed. There were no disclosures from the 5 parents. LPA did not receive a call back from the 6 parents. On 3/07/22, LPA interviewed 5 children. No disclosures made from the children. This agency has investigated the complaint alleging daycare child was hit while in care. Although the allegation may have happened or is valid, there is not enough preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is unsubstantiated. The complaint alleged daycare child was not properly dressed while in care. On 1/31/22, LPA interviewed C1 and P1. According to P1, on 12/2/21, C1 was soaked with water and urine at pick up time and C1 was not wearing a diaper nor underwear. On 2/15/22, LPA interviewed A2, who picked up C1, no disclosure was made. On 12/17/21 and 3/7/22, LPA interviewed 4 staff members including the director. The director indicated was not made aware about C1 until P1 informed of the incident after C1 was no longer enrolled. S2 stated a few minutes before pick up time, C1 peed on themselves and informed A2 at pick up time. S2 handed over the soiled clothing of C1 to A2. According to the 2 staff interviewed, they assist children change their clothes. All staff stated that the school has extra clothing, if children run out of clean clothes. The staff stated that children have plenty of spare clothes and diapers brought by the parents. Staff were unaware that C1 went home soiled and was no disclosures made regarding C1. On 3/07/22, LPA interviewed 5 of children. No disclosures made from the children. Page 3 This agency has investigated the complaint alleging daycare child was not properly dressed while in care. Although the allegation may have happened or is valid, there is not enough preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is unsubstantiated. Exit interview was conducted. Notice of Site Visit was posted during the visit. Director was informed that the notice of site visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100. Director was provided a copy of their appeal rights (LIC 9058 01/16) and their signature on this form acknowledges receipt of these rights. First level appeals should be sent to the regional manager to the address listed above.
