On 01/23/2023, the Regional Office received a complaint with allegations alleging Child sustained unexplained injuries while in care, Staff did not meet child's toileting needs, Staff spoke inappropriately when children in care were present, Staff did not provide child's authorized representative the telephone number of the Licensing Department.
During the course of investigation, LPA Tran inspected the facility postings, interviewed 5 staff, attempted to interview 7 children, interviewed 3 parents, and reviewed facility’s Handbook, daily schedule and children's files.
During a confidential interview, it was reported that Reporting Party heard from Adult #1 (A1) regarding staff were sharing personal information, which were inappropriate, while the children in care were present. When interviewed, A1 denied that A1 had ever heard staff shared inappropriate personal information while children were present. A1 also denied that A1 ever said that to anyone.
During interviews, LPA Tran interviewed 5 staff on 01/30/2023, all interviewed staff gave consistent answers about procedures regarding reporting injury incidents, which includes providing first aid as needed and document incident report to inform child's representative, on Pro Care app and in-person. All interviewed staff gave consistent answers regarding meeting toileting needs for the children including checking children's diaper every 2 hours and as needed if the child is still in need of potty training, and a bathroom break scheduled every 2 hours for the children who are already potty trained. All interviewed staff denied hearing other staffs sharing personal information, that were inappropriate, when the children were present. All interviewed staff denied that they had received any inquiries regarding Licensing's phone number and all interviewed staff were able to show LPA the location of Licensing's phone number at the facility's entrance. LPA attempted to interview 7 children including subject child on 04/11/2023, none of the children were qualified for the interview. LPA attempted to interview 5 parents on 04/10/2023, 3 out of 5 contacted parents responded and provided good feedback about the facility and have no concern related to the allegations.
During observation on 01/30/2023 and on 04/11/2023, LPA observed Department's phone number were posted on the bulletin of the facility and on Notice of Site visit in the entrance of the facility.

During record review, LPA reviewed children's file and observed Licensing's phone number on Parent's Rights in children's file. LPA also reviewed incident reports in children's files, which described the incidents that were alleged unexplained. LPA reviewed facility’s Handbook, which states procedures regarding reporting incidents and meeting children's toileting needs, as described by staff. LPA also reviewed the facility's preschool classroom daily schedule, which includes scheduled bathroom breaks approximately every 2 hours for the children in care.
Based on the information gathered from LPA's observation on 01/30/23 and on 04/11/2023, interviews conducted with 5 staff on 01/30/23 and with 3 parents on 04/10/2023, and record reviews facility’s Handbook, classroom daily schedule and children's files, there is insufficient evidence to corroborate the allegations that Child sustained unexplained injuries while in care, Staff did not meet child's toileting needs, Staff spoke inappropriately when children in care were present, Staff did not provide child's authorized representative the telephone number of the Licensing Department. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove that Child sustained unexplained injuries while in care, Staff did not meet child's toileting needs, Staff spoke inappropriately when children in care were present, Staff did not provide child's authorized representative the telephone number of the Licensing Department, did or did not occur, therefore the allegations that Child sustained unexplained injuries while in care, Staff did not meet child's toileting needs, Staff spoke inappropriately when children in care were present, Staff did not provide child's authorized representative the telephone number of the Licensing Department, are unsubstantiated.
Exit interview was conducted. The Notice of Site Visit was posted. Facility representative was informed that the Notice of Site Visit must be posted for 30 consecutive days. Failure to post will result in civil penalty of $100. “The licensee was provided a copy of their appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights.” This report LIC 9099 was provided to the director Susana Mendoza. First level appeal is to Regional Manager, address is above on the report.
