What the inspector wrote

Page 1 of 2 Licensing Program Analyst (LPA), Mahnaz (Nancy) Malek conducted an onsite case management inspection of this facility for the purpose of investigating an incident that the facility self reported to our office on 1/30/2026. LPA met with assistant director, Savannah Garcia. The new director, Debbie Rouintree was not present. The director, Zelinda Zazuetta form other Kindercare facility arrived during LPA's inspection. Census was taken. Upon arrival at 8:00 am, there were 10 preschool children with one staff member in one classroom. Another staff member arrived at 8:20 am in the preschool classroom. A review of the Facility Personnel Report Summary on this date indicates all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions. According to the self reported incident, on 1/30/2026 from 8:17am to 8:28am staff member was out of ratio. At t 8:17am staff member was alone with 13 children and by 8:28am staff member was alone with 16 children. They reported on staff member was late which caused staff member to be out of ratio. Today LPA interviewed the staff who were involved in the above reported incident. S1 admitted that on Friday 1/30/2026 S1 was left alone with 15 children but S1 did not know how many minutes S1 was left alone. S2 was not available for interview. S3 stated it has happened to be out of ratio. However, the date and time was unknown. Staff reported that they were out of teacher child ratio for few minutes on Friday January 30, 2026 in the morning. Continued on page 2 Page 2 of 2 LPA reviewed the Internal documentation of Child Supervision Record (CSR) for the mentioned date that was facility staff self reported. LPA observed that S1 was left alone with 14 preschool children from 8:17 am until 8:21 am for 5 minutes, and S1 reached to 15 preschool children from 8:21 to 8:25 for 4 minutes until S2 arrived. Then S1 left S2 with 16 preschool children from 8:26 am to 8:28 am for two minutes until the next staff arrived. Based on the self reported incident, and three staffs' interviews today, reviewing time card of staff for the incident date, and reviewing Child Supervision Record (CSR) dated 1/30/2026, it was determined that the facility was in violation of teacher child ratio being with one staff member for couple of minutes on different timing with 14 to 16 children. (The teacher child ratio for preschool is 1:12. The following deficiency was cited of the California Code of Regulations, Title 22, Division 12 on today's investigation regarding the incident of teacher child ratio which was self reported on 1/30/2026. Please see LIC 809D on next page for details of the deficiency. A previous licensing report was issued o 11/18/2025 giving notice of the same violation. Because the facility has been cited for repeating the same violation within 12 months, the following civil penalty shall be assessed until the violation is corrected. An immediate civil penalty of 250.00 is hereby assessed for the repeat violation. A notice of site visit was given and must remain posted for 30 days. Exit interview conducted and report was reviewed with the assistant director, Savannah Garcia. End of report .

This is a potential risk to the health and safety of children in care. An immediate civil penalty of 250.00 is hereby assessed due to a repeat violation of previous date of 11/18/2025.
