What the inspector wrote

Page 2 of 2 On 5/24/2024, the Orange County Child Care Office received a complaint alleging " Facility staff are operating out of ratio ". According to reporting party, on 5/24/2024, at 8AM the classroom had 10 toddlers with 2 staff. The RP reports there are no help available when out of ratio. LPA interviewed 8 staff regarding the issue of being out of ratio. They stated on occasions in the mornings they need help in the infant/toddler program and nobody checks on them to take census. The director stated she is in the process of getting Walkie Talkie device. The issue is normally between 8:00 to 8:30 am. Staff stated 2 staff are not working here as of last Friday. LPA reviewed the Child Supervision Record (CSR) for two days of last week. LPA found out that on last Friday 5/24/2024 there were 8 toddlers with 2 staff from 8:04 until 8:29 am, then the 9th toddler arrived at 8:29 am , the 10th toddler arrived at 8:31am. and the 11th toddler arrived at 8:48 am. That totals 9 children with 2 staff at 8:29am and 10 children with 2 staff at 8:31am, and 11 children with 2 staff at 8:48 am until the 3rd staff arrived at 9:01 am. The facility was out of ratio in Toddler Room. Based on LPA’s interviews with 8 staff, reviewing CSR for last Friday and today's observation (being out of ratio), it was determined the preponderance of evidence standard has been met, the allegation of “ Facility staff are operating out of ratio " is found to be SUBSTANTIATED. Type A under California Title 22 Regulations Section 101415(a)(b) staff infant ratio is cited on 9099D next page. Barbara Brown, the director was informed that the “Notice of Site Visit” must be posted for 30 consecutive days. The “Notice of Site Visit” must be posted on or adjacent to the door. Failure to post will result in Civil Penalties of $100.00. LPA Malek informed the director, Barbara Brown that this report dated 5/28/2024 documents type A citation shall be posted for 30 consecutive days as there is immediate risks to the health, safety, or personal rights of children in care. Also, LPA Malek informed the director, Barbara Brown to provide a copy of this licensing report dated 5/28/2024 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. The director, Barbara Brown, was provided with a copy of their appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days. The exit interview was conducted with director, Barbara Brown.

This requirement was not met as evidenced by today's observation, staffs' interviews, and reviewing CSR for Friday that there were 11 toddlers with 2 staff from 8:48 to 9:01 and today 9 toddlers with 2 staff from 8:10 to 8:20 am for 10 minutes until 3rd staff arrived. This is an immediate risk to the health and safety of children in care.
