What the inspector wrote

Page 1 of 2 Licensing Program Analyst (LPA), Mahnaz (Nancy) Malek conducted an onsite case management inspection for the purpose of checking into an incident that the facility self reported to our office on 7/9//2024. LPA met with director, Barbara Brown. LPA took census. There were a total of 17 infants and toddlers in two different rooms. There were 5 infants with 2 staff in the infant room, and 12 napping toddlers with one staff in the Toddler Room. Two other infant/toddler rooms were not in use. According to the self incident report, on 7/8/2024 toddler class was transitioning inside from playground. One toddler ran to the other side of the yard one and one staff followed the child. Child refuse to go inside, so the staff went inside to get another staff for help and left the child unattended for 30 seconds to a minute. A review of the Facility Personnel Report Summary on this date indicates all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions. Today LPA interviewed the director, and the staff who were involved in the incident with child # 1. (Staff # 1, Staff # 2, and Staff # 3). Staff # 1 was not present today. Child # 1 was too young to be interviewed. LPA interviewed Staff # 2 and Staff # 3. According to interviews with director, staff # 2 and staff # 3, reviewing the written self report incident, and Child Supervision Record (CSR), the incident was as below. On 7/8/2024 nine toddlers were being transitioned from the school playground to the toddler room with 3 staff around 10:50 am. The group of children lined up to walk towards the classroom while staff # 1 was at the end, staff Continued on page 2 Page 2 of 2 # 2 was in the middle, and staff # 3 was in front of the line. Child # 1 (23 months old) refused to move with the group. Child ran towards the adjacent playground and insisted not going to the classroom with the group. Staff # 2 and staff # 3 with 8 toddlers reached the toddler classroom passing two gates and around the corner of the building inside the facility. Staff # 1 stayed with child # 1 on the playground while the rest of the group had gone inside the toddler room. At this time staff # 1 decided to leave child # 1 unattended until staff could go inside the classroom and get help from another staff. Therefore staff # 1 walked 100 feet away from where child # 1 was and went around the building structure, passing two gates, asking staff for help to bring child # 1 inside. Child # 1 was left unattended for 30 seconds to a minute until staff # 1 got help. The estimated time was confirmed by the witnesses. Based on the interviews with the director, and staff # 2, and 3, reviewing the written incident dated 7/8/2024 and the Child Supervision Record (CSR), the incident was found out to be due to lack of supervision for 30 seconds to one minute. In the areas that were evaluated, the following deficiency was observed of the California Code of Regulations, Title 22, Division 12 on this inspection. Please see next page LIC 809D for detail of deficiency. A notice of site visit was given to director, Barbara Brown and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days. Failure to post will result in Civil Penalties of $100.00. Exit interview conducted and report was reviewed with the director, Barbara Brown. End of report

    101229 Responsibility for Providing Care and Supervision: No child (ren) shall be left without the supervision of a teacher at any time. Supervision shall include visual observation. This requirement was not met as evidenced by: facility's self report, and LPA's interviews with 3 staff stating during transition time from playground to classroom, 23 months old child refused to come in. Staff # 1 was with the child. Staff # 1 decided to go back in the classroom to get help and left the child unattended for 30 seconds or a minute to get help. This poses a potential risk to the health and safety of children in care.
