What the inspector wrote

Page 1 of 2 Licensing Program Analyst (LPA), Mahnaz (Nancy) Malek conducted an onsite case management inspection for the purpose of investigating an incident that the facility self reported to our office on 2/27/2026. LPA met with new director, Savannah Garcia. LPA took census. There were a total of 10 infants and toddlers with 3 staff in two different rooms. There were 3 awake infants with one staff in the infant room, and there were 7 toddlers with 2 staff in the Toddler Room. Two other infant/toddler rooms were not in use. A review of the Facility Personnel Report Summary on this date indicates all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions. According to the self reported incident, on 2/25/2026 all the toddlers were brought in after conducting a fire drill. S1 saw through the classroom's window that C2 belongs to another group of children crying outside on the preschool playground. S1 left the classroom to help C2 leaving 7 toddlers with one staff alone for few minutes. S3 who was outside with their own children noticed 16 months old toddler (C1) was left unsupervised at the gate on the hallway playground of toddlers. S3 notified S1 and S2. Then S1 went out of the toddler room and brought C1 in. Today LPA interviewed the staff who were involved or had information regarding the incident. S1, S2, S3, were interviewed. Regarding being out of ratio, the following information was obtained. S1 stated they transitioned the children from outside to inside the classroom. They helped C2 from the other side of the gate by holding C2's jacket. They had not gone inside the classroom yet. Therefore, there was no issue of leaving toddlers out of Continued on page 2 Page 2 of 2 ratio. S2 stated S1 left the room with door closed to help C2 at the gate on the playground, S3 stated they observed S1 and S2 were in transitioning to the classroom from outside hallway when S1 helped C2 at the playground fence. It was determined that two staff were with 7 toddlers staying in ratio. Regarding C1 was left outside the toddler classroom unsupervised, the following information was obtained. S1 stated they had no information regarding this incident. S2 stated they were inside the toddler classroom with S1 when they were notified by S3 calling staffs' names to let them know C1 had been left outside unattended. S2 stated they had conducted name to face and showed 7 toddlers. S2 was not sure how C1 was left unattended outside the classroom. S3 stated they were outside with their own group of children in the playground adjacent to the outside hallway of the toddler room. S3 stated after all the toddlers went inside, they observed their own group of children are at the playground gate, S3 walked forward and observed C1 was standing at the gate unsupervised. S3 estimated C1 was left unattended for couple of minutes. According to interviews, reviewing the written self report incident dated 2/25/2026, it was determined C1 has been left unsupervised for couple of minutes without two staff in charge of their group realizing it. In the areas that were evaluated, the following deficiency of Responsibility for Care and Supervision for infants section 101429(a)(1) was cited of the California Code of Regulations, Title 22, Division 12 on today's investigation regarding the reported incident. Please see next page LIC 809D for details of deficiency. The director, Savannah Garcia informed that the “Notice of Site Visit” must be posted for 30 consecutive days. The “Notice of Site Visit” must be posted on or adjacent to the door. Failure to post will result in Civil Penalties of $100.00. LPA Malek informed the director, Savannah Garcia that this report dated 3/2/2026 documents type A citation shall be posted for 30 consecutive days as there is immediate risks to the health, safety, or personal rights of children in care. Also, LPA Malek informed the director, Savannah Garcia to provide a copy of this licensing report dated 3/2/2026 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. The director, Savannah Garcia was provided with a copy of their appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days. The exit interview was conducted with director, Savannah Garcia. End of report.

    Responsibility for Providing Care and Supervision for Infants:(a) Each infant shall be constantly supervised and under direct visual observation and supervision by a staff person at all times. Under no circumstances shall ANY infant be left unattended. The above requirement was not met as evidenced by: self reported incident, and today's interview with 3 staff that 16 months old toddler (C1) was left unattended outside the toddler classroom unsupervised for couple of minutes without staffs' acknowledgement. This is an immediate risk to the health and safety of children in care.
