What the inspector wrote

Page 2 The complainant alleged staff speak inappropriately to daycare children. According to the complainant, when speaking with children, witnessed Director and Staff 2(S2) use a firm, rude tone of voice. On 12/9/22 and 1/31/23, LPA interviewed 4 staff members including the Director. According to the Director, all staff communicate with children at eye level and in a soft tone. S2 admitted in having a loud voice and communicate with children firm with lots of love. The 2 of 4 staff interviewed stated they have not witnessed any staff speak inappropriately to daycare children. Director stated a staff meeting was held in December 2022 to remind staff of communicating effectively with children. On 12/9/22 and 1/31/23, LPA interviewed 9 preschool children. There was no disclosure made from the 9 preschool children. On 12/29/22, LPA called 11 parents and interviewed 6 of the 11 parents. There were no disclosures made from the 6 parents interviewed. LPA did not receive a return call from the 5 parents. Based on interviews conducted, the complaint alleging the staff speak inappropriately to daycare children is found to be unsubstantiated. Although the allegation may have happened or is valid, there is not enough preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is unsubstantiated. The complainant alleged staff do not treat day care children equally. According to the complainant, Director shows a lot of favoritism to some children. However, complainant did not want to disclose the kind of favoritism to some children. On 12/29/22 and 1/31/23, LPA interviewed 4 staff members. The 4 staff interviewed all stated have not witnessed any staff show special treatment to some children. According to the Director, no parent has expressed any complaints nor concerns. Page 3 On 12/9/22 and 1/31/23, LPA interviewed 9 preschool children. There was no disclosure made from the 9 preschool children. On 12/29/22, LPA called 11 parents and interviewed 6 of the 11 parents. There were no disclosures made from the 6 parents interviewed. LPA did not receive a return call from the 5 parents. Based on interviews conducted, the complaint alleging staff do not treat day care children equally is found to be unsubstantiated. The complainant alleging staff do not allow day care children's parents to enter facility. Complainant stated the facility will not let parents in if children are on the playground. On 12/29/22 and 1/31/23, LPA interviewed 4 staff members. All 4 staff stated parents have the access code to enter the front gate. However, all staff stated parents are not allowed inside the classroom as to mitigate the COVID spread. The Director stated due to COVID precautionary, the parents drop off and pick up children in front of the door entrance to the classroom. The drop off/pick up procedure was implemented in the beginning of COVID. According to the Director, during the beginning of COVID, parents were unable to enter the front gate when children are present in the playground. However, this is no longer implemented since becoming the Director of the facility. On 12/29/22 and 1/31/23, LPA interviewed 9 preschool children. There was no disclosure made from the 4 preschool children. On 12/29/22, LPA called 11 parents and interviewed 6 of the 11 parents. There were no disclosures made from the 6 parents interviewed. LPA did not receive a return call from the 5 parents. Page 4 Based on interviews conducted, the complaint staff do not allow day care children's parents to enter facility is found to be unsubstantiated. Although the allegation may have happened or is valid, there is not enough preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is unsubstantiated. Exit interview was conducted. Notice of Site Visit was posted during the visit. Director was informed that the notice of site visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100. Director was provided a copy of their appeal rights (LIC 9058 01/16) and their signature on this form acknowledges receipt of these rights.
