What the inspector wrote

The reporting party (RP) alleged (1) Day care accepted child that was ill, (2) Staff did not notify authorized representative of child's illness (3) Staff did not take child's temperature, (4) Staff did not isolate child. During the staff interview on 08/23/23, LPA interviewed Staff #1 (S1) about the allegations. S1 stated they do not do wellness check anymore, but they observe the behavior of children and if they show symptoms of being sick. S1 stated they observe if there are any injuries. S1 also stated they notify parents immediately when child is not their normal self, and they check the temperature if there is a fever. If it is not an emergency, we continue to observe. If fever is 100 degrees and up, child needs to get picked up. S1 does not recall any child getting sick the week of Jul 31 to Aug 4. Staff #2 (S2) stated when they notice that a child has a different behavior, they start to check the forehead, observe if they do not eat and check the temperature. Staff #3 (S3) stated they observe children and check personality is off and behavior is not the same. S3 also stated she does not think anybody in her class was sick the week of Jul 31 to Aug 4. During the investigation and staff interview on 10/05/23 regarding allegation about Staff did not notify authorized representative of child's illness, LPA interviewed Staff #2 (S2) stated C1 was fine and doing activities in the morning and snacking during movie time, then at around noon C1 told S2 that she was cold. S2 also stated\342\200\235 I thought probably she was in the air-conditioned room that\342\200\231s why she was cold\342\200\235. S2 also stated C1 was is not hungry and does not want to eat, so she did not have lunch. S2 mentioned S2 observed C1 was tired and fell asleep during lunch around 12:10pm until child representative picked C1 up at around 12:30pm. Based on S2 interview, S2 stated she spoke to C1 representative during pick up at 12:30pm the same day and reported that C1 felt cold and fell asleep during lunch. S2 also told representative that C1 looked tired. Staff #3 (S3) stated C1 was her normal self in the morning, at lunch time at noon C1 said she was cold. S3 gave C1 a jacket and had her \342\200\234sit by the window where the sun is\342\200\235 S3 said. S3 also stated that C1 fell asleep where she was by the window. S3 stated S3 felt C1's head and it was not hot. S3 also stated they did not let the admin know and did not let C1 representative know because they think she was herself and nothing is unusual about C1 and it was almost pick up time. Based on record review on 08/23/23 of the facility\342\200\231s handbook, according to the facility\342\200\231s Illness/Sick Policy, they cannot accept children who are ill. It is also said in the facility\342\200\231s handbook that if the teacher or director feels that he/she is ill, the child will not be admitted. Page 2 of 3 On 9/11/23 LPA did a phone interview with children\342\200\231s representatives. 2 out of 5 responded regarding satisfaction of care. Adult #1 (A1) stated that the facility is \342\200\234fantastic\342\200\235 and if you want your child to start school, this is the childcare. \342\200\234They have good communication with parents, and they send pictures daily\342\200\235. A1 also stated that the facility uses an app to communicate. Adult # 2 (A2) stated she is happy, and the kids are happy and love the teachers. A2 also stated she is happy with the communication with the school. No children interviews were conducted due to children are non-verbal. Based on observation, interviews conducted and record reviews, the complaint alleging (1) Day care accepted child that was ill, (2) Staff did not notify authorized representative of child's illness (3) Staff did not take child's temperature, (4) Staff did not isolate child were found to be UNSUBSTANTIATED. Although the allegations may have happened or are valid, there is not enough preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are unsubstantiated. Exit interview conducted and report was reviewed with the director Melissa Nguyen. Appeal Rights. The facility representative was provided a copy of their appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. page 3 of 3
