What the inspector wrote

Licensing Program Analyst (LPA), Patricia Duron conducted an unannounced Case Management visit for the purpose to discuss the Lead Sampling re-testing conducted on 11/19/22. LPA explained the reason for today’s visit when I met with Director, Gerardo Soto LPA observed 78 preschool children in care. Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018 requires all licensed Child Care Centers (CCC’s) constructed before January 1, 2010 to test their drinking water for lead contamination between January 1, 2020 and January 1, 2023, and then every five years after the date of the first test. Community Care Licensing was notified that lead water testing conducted at the facility on 11/19/22 failed the allowable limit for lead. The Purpose of today’s visit is to follow up lead re-testing results of Action Level Exceedances (ALE). Facility had a Plan of Correction, which they completed and retested outlet F, which is now outlet A due to the re-test and new label. Due to outlet’s re-test result of 7.8 for outlet A, facility has been flushing outlet from 12/5/22 to 12/21/22 every day four times a day, with the water running for two minutes every flush. Director stated facility will continue to flush outlet until the outlet is re-tested again in January. LPA observed flushing log with dates and times facility has been flushing outlet. LPA observed the Lead Sample Report posted on the front of the building visible to parents/ guardians. Page 1 of 2 On 12/16/22 LPA spoke with Regional Director,Courtney Nolan who stated that one outlet that had ALE over 5.5 had been made inaccessible to children for drinking via, sign posted stating Please Do Not use this sink. The outlet is covered with caution tape, and is also inaccessible to children due to outlet located in a locked room that is used for storage. No deficiency was observed in the areas that were inspected, in California Code of Regulations, Title 22, Division 12 at the time of the visit. Exit interview conducted with Director Gerardo Soto.and the report was reviewed and discussed. Appeal Rights were discussed. Facility staff was provided copy of their appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received the Regional Office within 15 business days. The staff was informed that the "Notice of Site Visit" must be posted for 30 consecutive days. The Notice of Site Visit must be posted on or adjacent to the door. Failure to post will result in Civil Penalties of $100.00. End of Report. Page 2 of 2.
