What the inspector wrote

Licensing Program Analyst (LPA) A. Bootorabi conducted an unannounced visit for the purpose of a self-reported Unusual Incident Report (UIR) on 08/25/2023 . The purpose of today’s visit is for the delivery of the findings of the self-reported UIR. Upon arrival, the LPA met with the Director, SOTO, GERARDO, and informed the purpose of the visit. Census: Room 10: 13 children 1 Staff / Room 11 : 19 Children - 2 Staff / Room 12: 13 Children 2 Staff / Room 13: 10 Children 1 Staff / Room 15: 13 Children - 2 Staff / Tots Room 19: 13 Children - 3 Staff The facility representative was reminded that all adults 18 and over, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated. On 08/23/2023 the facility self-reported an incident pertaining to a child's (C1) personal rights being violated. The facility received a verbal complaint from C1’s parents stating that C1 disclosed to them that a staff member had physically harmed their child, the parent was not able to provide dates or name of staff. The facility staff S1 asked P1 if C1 sustained any injuries, P1 mentioned that there was no visible injuries and only a statement C1 made. Director extended an invitation to talk with parents and teachers, but parents decline the meeting and requested licensing phone number. The director provided the information for licensing office and the facility's license number for parents reference. On 8/25/2023 LPA interviewed 1 Staff member present at the facility (S5). On 9/14/2023 the LPA interviewed 4 staff (S1, S2, S3). On 11/29/2023 the LPA interviewed S4.. LPA interviewed a total of 5 staff. 5 of 5 staff made no disclosures of themselves or other staff violating children’s personal rights while in care. LPA interviewed 5 (C1 – C5) children on 8/25/2023. 3 of 5 (C1, C2, C5) children were qualified by means of asking them a series of questions. 2 of 3 (C2 & C5) qualified children made no disclosures of their personal rights being violated or being physically harmed by staff. LPA interviewed (C1) child disclosed physical harm by a staff member but was not able to clearly provide a name of a staff or dertails of the incident. LPA attempted to continue the interview but had difficulty comprehending the child’s speech or name of a staff. LPA called C1’s parent and left a voicemail on 9/8/2023. LPA did not receive a call back from the parent as of 11/28/2023. LPA called 5 parents (P2-P6) and out of the 5 parents called on 10/11/2023 the LPA was able to communicate and interview 1 (P4). No disclosure of children's personal rights being violated was disclosed. Based on Staff, Children, and Parent interviews there is not enough evidence to substantiate the allegation. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation(s) did or did not occur, therefore the allegation is unsubstantiated . An exit interview was conducted with Director, SOTO, GERARDO . Notice of Site Visit was posted during the visit. The director was informed that the notice of the site visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100. The director was provided with a copy of their appeal rights (LIC 9058 01/16) and their signature on this form acknowledges receipt of these rights. First-level appeals should be sent to the regional manager to the address listed above.
