What the inspector wrote

On 02/05/2026, Licensing Program Analyst (LPA) Deschampe conducted an unannounced case management inspection as a result of a self-reported Unusual Incident Report (UIR)(LIC 624) received on 02/02/2026 regarding a child left unsupervised. At 12:30 PM LPA entered the facility and met with Silvia Magalhaes. Total enrollment is 107, with a census of 64 children and 19 staff at the time of the walk through due to varied student schedules, third party appointments, and children who are sick. A review of the Facility Personnel Report Summary on this date, 02/05/2026 indicates all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions. Per UIR, on Friday 01/30/2026 at approximately 4:30 PM Parent 1 (P1) opened the room 11 door and saw Child 1 (C1) inside the classroom unattended (in the library area, looking at a book). P1 immediately notified staff that were outside the play area (in between the office and classroom 11). Staff 1 (S1) went inside to get C1. Children and staff were outside from approximately 4:15 PM. During the investigation, LPA made observations, interviewed staff, and obtained pertinent documentation. No children interviews were conducted due to not qualifying for the Ten Step Investigative Interview questions. At the time of the incident, the facility had 45 children and 12 staff, with 14 children and 4 staff present in the location of the incident. During the staff interviews, staff confirmed C1 was left without staff supervision in the classroom. Based on LPA’s interviews, observation, and record review, there was adequate evidence to support a Type B deficiency. California Code of Regulations, Title 22 Division 12 Chapter 1, Section 101229(a)(1) Responsibility for Providing Care and Supervision , which is being cited on the attached LIC 809D. The exit interview was conducted with the facility representatives, Christy Pate and Silvia Magalhaes. The Notice of Site Visit was posted during the visit. The facility representative was reminded that the Notice of Site Visit must be posted for 30 consecutive days. Appeal Rights were discussed and provided to the facility representative and their signature on this form acknowledges receipt of these rights. Licensee must file an appeal, in writing, to the Regional Manager within 15 business days from the date of receiving the penalty assessment or notice of deficiency. First level appeals should be sent to the Regional Manager at the address listed above. End of report
