What the inspector wrote

On 12/18/24 at 12:15pm, Licensing Program Analyst (LPA) Sarah Garcia conducted a case management- incident visit in response to a self-reported unusual incident report (LIC 624) received on 10/14/24 regarding children being left unattended. This is a follow up visit initiated on 10/22/24. LPA met with director, Jennifer Patterson. A walk through of the facility was conducted, and census was taken. Total census was 0 school age children and 0 staff. On 10/14/24, a self-reported Unusual Incident Report (UIR) was filed with the Licensing Office. The facility reported that on 1/10/24 at approximately 1:30pm, a group of school age children had been left alone for approximately two minutes by Staff 4 (S4). On 01/10/24, Staff 4 (S4) had transported a group of school age children to the School Age classroom 2. In searching for Staff 3(S3), they saw another teacher, Staff 1(S1) in the classroom next door. S4 left the classroom for approximately 2 minutes, upon return S1 and S2 (S2) informed management that S4 left the children unattended. During staff interviews on 10/22/24, Staff 1 (S1) stated, \342\200\234I was on my lunch S4 came in looking for who was in the classroom, and S4 was walking away and left the kids.\342\200\235 S1 stated, \342\200\234S4 was standing in the between the divider and wall and [they] turned back and said shut up. [The children] were being loud, and S4 yelled at the kids shut up.\342\200\235 Staff 2 (S2) stated, \342\200\234S4 brought them there [school age 2] and came over to me and S1 was on her lunch in the middle class. S4 was asking if we knew. I can\342\200\231t remember if S4 told the kids to shut up." Continued on Page 2 Page 2 Staff 3 (S3) stated, \342\200\230What I had heard was that S4 came back from the bus run walked the kids to the classroom two S4 came back to see who was going to relieve them. S4 went back and that was that.\342\200\235 LPA interviewed (4) children on 10/22/24. Children made no disclosures regarding the incident. Based on interviews and record review, it has been determined that S4 left daycare children unattended, S4 yelled at day-care children in care, and facility did not report this incident to the Department in a timely manner. LPA Sarah Garcia informed director, Jennifer Patterson that this report dated 12/18/24 document(s) (2) Type A citation(s) which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, and personal rights to the children in care. Also, LPA Garcia informed director to provide a copy of this licensing report dated 12/18/24 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months form the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224) or other written statement must be kept in the child's file for verification. An exit interview conducted with Director, Jennifer Patterson. Notice of Site Visit was provided and must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100.00.

To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation,……including but not limited to: interference with functions of daily living including eating, sleeping or toileting…This requirement is not met as evidenced by: Based on interviews, Staff 1 (S1) and Staff 2 (S2) disclosed that on 1/10/24, Staff 4 (S4) yelled at daycare children in care.

  • RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION

    101229 Responsibility for Providing Care and Supervision (a) The licensee shall provide care and supervision....(1) No child(ren) shall be left without the supervision of a teacher at any time..."This requirement was not met as evidenced by: Based on interviews, on 1/10/24 at approximately 1:30pm, Staff 4 (S4) left a group of children in school age room 2 unattended for approximately 2 minutes. This is an immediate risk to the health, safety, and personal rights to children in care.
