Reporting Party (RP) stated, the kids had a 4th of July party on 7/3/23 and photos were posted to Facebook. The photos show the kids all got hot dogs and grapes, all whole. Hot dogs and grapes are literally the two most dangerous foods when it comes to children choking. During the course of investigation, LPA interviewed 3 staff members, and 3 parents. During the staff interview, Staff 1 (S1), Staff 2 (S2), Staff 3 (S3) stated, they cut the little ones (preschool-age) food so that it is served appropriately according to their ages. Licensee stated she normally always cuts the preschoolers food but admitted to an oversight on the day of their Fourth of July party due to a lot that was going on that day. Licensee stated she did cut up the food for the 18 month old children that day but not the rest. Licensee said she has plenty of pictures from other days before and after the 4 th of July party showing she cuts up the younger children\342\200\231s food. The licensee and assistant failed to cut the whole grapes and whole hot dogs for all the children that are considered the most vulnerable to choking hazards which is from infants to 4 years old. 3 of 5 parents were interviewed, parents had no issues or concerns with the daycare. Based on interviews conducted and photos, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED . California Code of Regulations, Title 22, Division 12, Chapter 1 Section 102423(a)(2) Personal Rights is being cited on the attached LIC 9099D. Please refer to attached 9099D for documentation of deficiencies. Exit interview was conducted. The Notice of Site Visit was posted. Appeal Rights was explained.
