Licensing Program Analyst (LPA), Stacy Torrence conducted an onsite inspection for the purpose of an Annual Random. LPA and Licensee toured the facility inside and outside and the floor and yard plan (LIC 999) were verified. LPA observed licensee and assistant, caring for three infants and seven preschool children, playing outside. Licensee was operating within the licensed capacity as specified on license. Currently there are two adults including the licensee living in the facility. Facility Day Care hours are 7:00am-5:30pm, Monday through Friday. A review of the Facility Personnel Report Summary on this date indicates all facility residents, staff, or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions. During today\342\200\231s inspection, LPA and licensee toured the inside and outside areas identified in the facility sketch as accessible to childcare children. The childcare area consists of the family, one bathroom, and backyard. There is a child safety gate at the bottom of the stairs leading to the second floor. The facility has conducted an emergency drill within the past six months. There are working carbon monoxide, smoke detector, and fire extinguishers in the home that meet statutory and State Fire Marshall standards. Detergents, cleaning compounds, medicines, and other items which could pose a danger if readily available to children were stored inaccessible to children. Licensee stated there are no firearms and/or other dangerous weapons in the facility, and none were observed during today's inspections. There is a fireplace, located in the living room, barricade by a glass cover. The home has age appropriate toys for the ages served. LPA verified there is a working telephone service (cellular service). Licensee stated they use the backyard as outdoor play area. There are no bodies of water on the premises. Licensee has a large dog in a cage, in the childcare room, and is updated with shots. Page 2 The licensee does have a current roster of children in care. Children\342\200\231s records for children present during LPA\342\200\231s inspection were reviewed for a copy of the emergency information card that contains all the information specified by regulation (LIC 700) and found to be in compliance. LPA observed 2 infants from 0-12 months. LPA did not observe the LIC 9227 Individual Sleep Plan in C1 and C3 records. Licensee did not have documentation of 15-minute check for sleeping infants. The licensee and assistant\342\200\231s Pediatric CPR/First Aid certification expired 03/2024 and 4/2024 respectively. Beginning September 1, 2016, Health and Safety (H&S) 1597.622 states, a person shall not be employed or volunteer at a family childcare home if he or she has not been immunized against influenza, pertussis, and measles. Proof of immunization against pertussis, measles for licensee were reviewed and within compliance. Beginning March 31, 2018, H&S Code 1596.8662 requires all licensed providers and employees to complete mandated reporting training, and to renew the training every two years. Licensee and assistant are in compliance with the required mandated reporter training. Incidental Medical Services (IMS) policy was discussed. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. The licensee understands she must be present in the facility and must ensure children in care are always supervised. Children are not to be left alone in parked vehicles. When the licensee is temporarily absent from the facility, arrangements must be made for a qualified substitute adult to care and supervise children while absent. The substitute adult must have the required criminal record, child abuse index clearances, immunizations, Pediatric CPR/First Aid, and mandated reporter training. LPA provided Guardian Information and website info: https://www.cdss.ca.gov/inforesources/cdss-programs/community-care-licensing/caregiver-background-check/guardian Page 3 Licensee was reminded that all adults 18 and over, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated. The licensee was informed that Licensing Quarterly Updates are available at www.ccld.ca.gov facility representative may request to be added to an email list to receive a Quarterly Update from www.ccld.ca.gov and select Receive Important Updates link. LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed facility representative of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. Based on LPAs record reviews the following violations were observed and are being cited in accordance with California Code of Regulations, Title 22, Division 12, Chapter 3, Section 102425(j)(1) Infant Safe Sleep and 102425( c) Infant Safe Sleep are being cited on the attached LIC 809D. An Inspection and exit interview were completed with licensee. The report was reviewed and discussed. Appeal Rights was discussed. The facility representative was provided a copy of their appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days. The licensee was informed that the \342\200\234Notice of Site Visit\342\200\235 must be posted for 30 consecutive days. The \342\200\234Notice of Site Visit\342\200\235 must be posted on or adjacent to the door. Failure to post will result in Civil Penalties of $100.00.
