What the inspector wrote

On 07/18/2024 at 11:40am an unannounced Annual random inspection was conducted at the facility by Licensing Program Analyst (LPA) Anna Chan. LPA observed licensee Celia Martir being assisted by Adult Resident #1 (A1) caring for 8 children. The children had just finish water play at the backyard. Licensee was operating within the licensed capacity as specified on license. A review of the Facility Personnel Report Summary on this date indicates 2 adult resident age 19, and 20, who require caregiver background checks have not received criminal record and child abuse index clearances or exemptions. Currently there are 3 adults including the licensee and no minor child living in the home. Facility Day care hours are 7:00am-6:00pm, Monday through Thursday. Summer Schedule 8:00am-4:30pm Tuesday through Thursday. Regular school day starts August 12, 2024 this year. Based on interview, A1 stated A1 helps licensee often with breakfast etc. A1 stated A1 has been helping the licensee even before turning 18. Based on interview with Licensee, licensee stated her assistant was on vacation since end of June 2024 and A1 has been helping her with assisting children when ratio reaches more than 8 children. During today\342\200\231s inspection, LPA and licensee toured the inside and outside areas identified in the facility sketch as accessible to childcare children. Upon entering is the living room. The main day care area is the daycare room which is past the living room. There is a backyard accessible in the day care area. Licensee stated, the backyard is being used for childcare, weather permits. Off limits areas are kitchen, all 3 bedrooms, 1 bathroom inside the Master\342\200\231s bedroom and garage; off limit areas are made inaccessible by means of baby gates. Licensee acknowledges that children are never to enter an off-limit area of the home. Page 1 of 4 There are working carbon monoxide, smoke detector, and fire extinguishers in the home that meet statutory and State Fire Marshall standards. The facility has conducted an emergency drill on July 9, 2024. Detergents, cleaning compounds, medicines, and other items which could pose a danger if readily available to children were stored inaccessible to children. There were no poisons or other items observed which could pose a danger to children or if they were observed, they were locked or inaccessible. Licensee stated there are no firearms and/or other dangerous weapons in the facility and none were observed during today's inspections. There is a fireplace and in the living room screened by a mesh covering and another 3-panel screen cover, and inaccessible to children in care. The home has age-appropriate toys for the ages served. LPA verified there is a working telephone service (cellular service), licensee was reminded that childcare phone needs to remain the in the childcare at all times. There are no pools in the facility, although there is a wading pool (plastic kiddie pool) in the backyard. Licensee was reminded that wading pools should be emptied out after use. 5 Children\342\200\231s records for children present during LPA\342\200\231s inspection were reviewed for a copy of the emergency information card that contains all the information specified by regulation (LIC 700), Immunization records, Affidavit Regarding Liability Insurance (LIC282), Consent for Emergency Medical Treatment (LIC627), Notification of Parent\342\200\231s Rights (LIC995A) and found to be in compliance. Licensee stated there is 1 infant under 24 months in care. The licensee\342\200\231s Pediatric CPR/First Aid certification expires on 10/2024. Beginning September 1, 2016, Health and Safety (H&S) 1597.622 states, a person shall not be employed or volunteer at a family childcare home if he or she has not been immunized against influenza, pertussis, and measles. Proof of immunization against pertussis, measles for licensee were reviewed and within compliance, and influenza shot . Beginning March 31, 2018, H&S Code 1596.8662 requires all licensed providers and employees to complete mandated reporting training, and to renew the training every two years. This facility plans to provide Incidental Medical Services \342\200\223 IMS. For IMS information, see PIN 22-02-CCP . A Plan for Providing IMS must be submitted to the Department. Children are not to be left alone in parked vehicles. When the licensee is temporarily absent from the facility, arrangements must be made for a qualified substitute adult to care and supervise children while absent. The substitute adult must have the required criminal record, child abuse index clearances, immunizations, Pediatric CPR/First Aid, and mandated reporter training. LPA also informed licensee [facility representative] of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. The facility was not in compliance and violations of the California Code of Regulations, Title 22, Division 12 were observed, discussed and cited at the time of the visit. The following violations of the California Code of Regulations, Title 22; Division 12, were observed and cited today: Type A for Health and Safety Code Administration of Child Day Care Licensing 1596.871(c)(1)(A) (see LIC 809D). Civil Penalty assessed. Licensee was given a print out of LIC9163 Livescan form with guidelines page, a copy of Health and Safety Code Article 2 Administration of Child Day Care Licensing 1596.871(c)(1)(A) Fingerprints and criminal record information\342\200\246 LPA Chan informed licensee Celia Martir, that this report dated 07/18/24 documents 1 Type A citation which shall be posted for 30 consecutive days as there is immediate risk to the health, safety, or personal rights of children in care. Page 3 of 4 Also, LPA Chan informed the licensee Celia Martir to provide a copy of this licensing report dated 07/18/2024 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated. The Licensee was provided a copy of appeal rights (LIC 9058 03/2022) and their signature on this form acknowledges receipt of these rights.
