What the inspector wrote

RP stated that the licensee would tell C1 "You are acting like a baby" and asked C1 " Why are you so tall?" The licensee's comments made to C1 feel "less than." During the course of investigation, LPA interviewed 2 staff members, 3 parents and 5 children. During the staff interviews, Staff 1 (S1), disclosed that the way S1 manages challenging behaviors is, \342\200\234I talk to them and use books to help them sort out their emotions, so we figure out what\342\200\231s going on. I talk a lot to the children and listen to what they have to say. I put them on quiet time so they can regroup.\342\200\235 S1 denied ever grabbing C1 or any other child in a rough manner or speaking inappropriately to children. S1 stated S1 never made fun of C1 at all. S1 said there was times C1 did not want to go home and stated S1 had a positive relationship with C1, C1 attended the daycare for many years. Licensee disclosed that sometimes we grab kids to separate them but not in an inappropriate manner to hurt them. C1 was here all of 2019 so if something had happened why would the parent not say anything and still bring C1? C1 was 3 yrs. old in 2019. There was not anything that wasn\342\200\231t typical from a 3 yr. old nothing really stands out as far as 2019. Staff #2 (S2) stated, S1 never yells at children, S1 just speaks kind of loud and denied that S1 ever speaks inappropriately to children. S2 stated the discipline policy is children get 2-3 warnings and then they get put on time out. S2 also denied that S1 ever grabbed a child in a rough manner. 3 of 12 parents were interviewed, 3 of 3 parents interviewed had no issues or concerns with the daycare. LPA also obtained 4 character reference letters from parents on behalf of the licensee. LPA interviewed 5 children and the children did not make any disclosures. LPA observed that the Licensee has a strong loud voice when speaking. Her tone is not rough but it is strong when speaking to the children. It can be perceived as yelling but not in rough tone, it's more the Licensee projects her voice to get the children's attention. Based on LPA\342\200\231s interviews and record review, there is insufficient evidence to corroborate the allegation of Licensee handled daycare child in a rough manner and Licensee spoke inappropriately to daycare child. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violation s did or did not occur; therefore, the allegation is UNSUBSTANTIATED. Page 2 of 3 Exit interview was conducted, and report was reviewed and discussed. Notice of Site Visit was posted during the visit. The facility representative was informed that the Notice of Site Visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100 per day. The facility was provided a copy of their appeal rights (LIC 9058 12/15) and their signature on this form acknowledges receipt of these rights. Page 3 of 3. End of Report.
