Based on observation, interview, record review, At 11:00am, during staff file review Staff #2 (S2) immunization records were not available for review. The licensee did not comply with the section cited above in which poses a potential health, safety or personal rights risk to persons in care.

102416.2 Reporting Requirements (b) The licensee shall report to the Department any of the events as specified in H&S Code 1597.467(b)(1)(A) through (b)(1)(C) that occur during the operation of the FCCH. (3) H&S Code 1597.467(b)(1) provides in part: (C) Any unusual incident or child absence that threatens the physical or emotional health or safety of any child." This requirement was not met as evidenced by: Licensee failed to inform the Department of an incident that occurred where a child sustained an injury that threatens the physical or emotional health of the child. This poses a potential risk to the safety of children in care.

STAFFING RATIO AND CAPACITY

102416.5 Staffing Ratio and Capacity (e) If no assistant provider is present at a Large Family Child Care Home, the licensee shall comply with the capacity requirements for a Small Family Child Care Home. This requirement was not met as evidenced by: LPA observed Licensee caring for 4 infants below the age of 2 years old and 2 children of age 2 years old for 45 minutes before Assistant Angelica arrived. This is an immediate threat to the safety of the children in care.

INFANT SAFE SLEEP

Infant Safe SleepThe provider shall supervise infants... and shall document... in the infant’s file and be available to the Department for review. Documentation shall include the following, date, infant’s name, and time of each 15-minute check. This was not meet as evidenced by: Based on LPA Corral record review, Licensee did not have documentation available for 1 out of the 2 infants present in care. This poses a potential safety risk of the children in care.

Availability of InformationOn or before March 30, 2018, a person who is a licensed child care provider... shall complete the mandated reporter training and complete renewal mandated reporter training every two years following the date which he/she completed the initial mandated reporter training. This was not meet as evidenced by: Based on LPA Corral record review, Licensee completed her mandated reporter training on 12/19/2018 but did not complete the renewal mandated reported training. This poses a potential safety risk of the children in care.
