What the inspector wrote

The reporting party stated that they witnessed the same staff member being rough with other children in care on other occasions. It was stated that the same staff member yanked on a child\342\200\231s arm for standing too close to the TV. The reporting party stated that they did not observe any marks on the children while present at the facility. Exact dates of the occurrences were not provided by the reporting party. LPA, Gutierrez contacted the reporting party several times between the dates of 09/14/2022 \342\200\223 10/24/2022 and left voicemail message to call LPA back. LPA was not able to interview the reporting party. On 09/15/2022. LPA Gutierrez made an unannounced inspection to the facility regarding the allegations of Personal Rights. LPA Interviewed the Licensee, Staff #1, attempted 03 children interviews and obtained a copy of the children\342\200\231s facility roster (LIC 9040). During the interviews conducted the staff interviewed were asked what the discipline policy is and if the children were ever yelled at or handled in a rough manner while in care at the facility. Licensee stated that the children do get time out (which is sitting by the gate area in the on limits back yard) at the facility and stated that that she or no other staff yell or physically discipline the children in care. Staff #1 stated that the children are talked to, separated, redirected and placed in time out on the floor outside for 10-15 minutes. All staff stated that they do not yell or use physical discipline at the childcare. Staff #1 stated that he/she does pick a child up under their arms to separate them. On 09/15/2022 LPA, Gutierrez attempted to interview 03 children while at the facility. LPA was not able to qualify the children due to the age and the limited language abilities. On 09/17/2022 \342\200\223 09/22/0222 LPA, Gutierrez conducted 05 parent interviews via phone calls of the children enrolled at the facility. There were no disclosures by any of the parents interviewed regarding the allegations mentioned. Based on LPA\342\200\231s observation and interviews conducted the allegations referenced on this report is Unsubstantiated. A finding of Unsubstantiated means that although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the allegation occurred. Exit interview conducted and report was reviewed with the licensee, Pamela Ayers . Appeal Rights were discussed. The facility representative was provided a copy of their appeal rights (LIC 9058 ) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. Page 2 o f 2

    Personal Rights 102423 (a) Each child receiving services from a family child care home shall have certain rights that shall not be waived or abridged by the licensee regardless of consent or authorization from the child's authorized representative. These rights include, but are not limited to, the following: (1) To be treated with dignity in his/her personal relationship with staff and other persons.This regulation was not met as evidence by statement provided by Staff #1 that the children receive a time out at the facility by being place outside by gate area for 10-15 minutes while in care. This poses a risk to the children in care.
