What the inspector wrote

Page 2 During the investigation, LPA interviewed licensee, interviewed assistant, interviewed parents, reviewed staff files, reviewed children files, and took pictures. Staff inappropriately discipline daycare children. RP stated a staff member would put children in the closet for up to an hour if a child would not stop crying. During interviews with licensee and assistant, both denied placing children in any closet. Licensee and assistant stated as a form of discipline, they separate the children if they become physical with each other and sit the children on the bench inside the home near the front door as a form of time out as they talk to them. LPA Wasn\342\200\231t able to verify that children were being placed inside the closet as a form of discipline. However, over the course of the investigation, LPA did learn through interviews that an assistant was observed pinching and pulling the ear of child #1(C1) as the assistant brought C1 into the house from the outside play area. Parent interviews were conducted. LPA contacted five parents via phone call. Out of five parents, three parents were able to be interviewed. Parents interviewed did not divulge and information pertaining to the allegations. LPA attempted to interview children on 8/5/2024. During the visit there were eight children present. LPA attempted to conduct interviews with all eight children present via Russian translator. All eight children were not verbal with the Russian Translator. Based on interviews and learning an assistant was observed pinching and pulling the ear of (C1) ; the preponderance of evidence standard has been met; therefore, the above allegation is found to be SUBSTANTIATED. California Code of Regulations, Title 22, Division & Chapter 12, is being cited on the attached LIC 9099 D for the deficiency section 102423 Personal Rights (a) Each child receiving services from a family child care home shall have certain rights that shall not be waived or abridged by the licensee regardless of consent or authorization from the child's authorized representative. These rights include, but are not limited to, the following: (4) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse, or other actions of a punitive nature, including, but not limited to: interference with eating, sleeping or toileting; or withholding shelter, clothing, medication or aids to physical functioning. Page 3 LPA Thompson informed licensee Svetlana Chernobrovina that this report dated 10/28//2024, document(s) one Type A citation which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care. Also, LPA Thompson informed the licensee Svetlana Chernobrovina to provide a copy of this licensing report dated 10/28/2024, 2024 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. Exit interview conducted and report was reviewed with licensee Svetlana Chernobrovina. Notice of site visit was given and must remain posted for 30 days. Failure to comply with the posting requirements shall result in an immediate civil penalty of $100. Appeal Rights and deficiencies were discussed. The Director was provided a copy of their appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days.

During interviews, LPA learned an assistant (A1) was observed pinching and pulling the ear of Child #1 (C1), which poses an immediate health, safety or personal rights risk to persons in care.
