Inspector’s narrative

What the inspector wrote

RP has witnessed children running ahead of the licensee, up to four houses in front of the licensee. RP stated that the licensee yells after the children to slow down. RP is worried that the children will be hit by cars because cars travel very fast in their neighborhood. RP has witnessed the licensee's dog running out of the house and confronting another neighbor's dog. The children then ran out after the dog, but RP didn't see the licensee anywhere. RP overheard licensee blaming the children for the dog getting out of the house. During the course of investigation, LPA interviewed licensee and 2 parents and 5 children. During the staff interviews, Staff 1 (S1) stated, I don\342\200\231t ever take the daycare children to walk around the neighborhood. There is another provider down the street she walks her daycare children almost every day but not me. They play in her driveway, and she walks them around. My children only play in my backyard. S1 also denied yelling at the children. S1 stated,\342\200\235 No not at all, I\342\200\231ve called their attention, but I don\342\200\231t yell at them. I talk to the children if there is a problem, there is no need to yell at them. I talk to the kids and tell them the difference from right and wrong and I explain things to them. LPA interviewed 5 children, Child #1 (C1) stated, yes, the licensee always watches the kids and no the kids are not left alone. C1 denied that the licensee takes C1 and the other children for walks through the neighborhood and said No, she doesn\342\200\231t take me she only takes herself. C1 said that S1\342\200\231s dogs are always nice and no way they do not fight with other dogs. When asked if S1 ever yells at the kids, C1 stated, \342\200\234Sometimes but not mean. Sometimes when we are outside in the backyard because the kids are screaming when they play.\342\200\235 Child #2 (C2) said S1 always watches the kids and S1 is very nice to them. C2 disclosed that S1 does take all the kids for a walk and the dogs come too. C2 said that kids do not run ahead but do stay with S1. C2 said S1\342\200\231s dogs are nice and no they do not fight with other dogs, only sometimes bark or play together. The dogs stay with us. C2 also stated that S1 talks to children when they get in trouble, and they go on time out. C2 stated S1 does not yell at the kids but rather talks to them. Child #3 (C3) stated \342\200\234S1 is always watching us. S1 is nice and does not yell at the kids. S1 walks C3 and some of the kids around. The dogs come with them but they do not fight with other dogs or run ahead\342\200\235. Child #4 (C4) stated: \342\200\234S1 is always watching the kids. S1 does not take C4 and the other kids for walks through the neighborhood. S1 is very nice. S1\342\200\231s dogs are nice. They do not fight other dogs or go out alone. If a kid gets in trouble they go on time out, for like 5 minutes. S1 talks to us and says no, calmly. Like normal talking she doesn\342\200\231t yell.\342\200\235 C4 denied that S1 ever yells at any of the kids. Child #5 (C5) stated: \342\200\234S1 always stays with the kids. They used to (go on walks) but not anymore but that was a long time ago. Page 2 of 3. We stopped because we didn\342\200\231t want to go anymore. During the walks the kids listen to licensee. Yeah, the dogs came too, and they behaved and don\342\200\231t fight. S1 does not yell at the kids but S1 brings them inside and sits them down in a chair and are in time out for 5 minutes.\342\200\235 LPA observations, licensee has two senior dogs that are extremely well behaved, one dog is blind and has a medical condition. LPA has not observed dogs showing any aggression nor do they go outside in the front yard alone. 2 of 2 parents were interviewed, parents had no issues or concerns with the daycare. Based on the information gathered from LPAs\342\200\231 interviews, observation, and reviewing records, there is not enough evidence to corroborate the allegations of Licensee does not provide supervision at all times and Licensee mistreats children by yelling at them. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the allegations did or did not occur in the day care facility, therefore the allegations are UNSUBSTANTIATED . Exit interview was conducted, and report was reviewed and discussed. Notice of Site Visit was posted during the visit. The facility representative was informed that the Notice of Site Visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100 per day. The facility was provided a copy of their appeal rights (LIC 9058 12/15) and their signature on this form acknowledges receipt of these rights. Page 3 of 3. End of Report.
