ARTICLE 2. Administration of Child Day Care Licensing

Based on record review, licensee did not have proof of mandated reporter training for herself, the licensee did not comply with the section cited above in 1 out of 3 files reviewed, which poses/posed a potential health, safety or personal rights risk to persons in care.

1596.8595(c)(1) H&S 1596.8595(c)(1) Posting licensing report by child care facility or home.. (c)(1) A licensed child day care facility shall provide to the parents or guardians of each child receiving services in the facility copies of any licensing report that documents any Type A citation that represents an immediate risk to the health, safety, or personal rights….. This requirement is not met as evidence by: Based on LPAs records reviews, interviews, and observation, it was discovered that licensee failed to give parents copies of the licensing report that documents any Type A…. and the LIC 9224 Acknowledgment of Receipt of Licensing Report to the parents of the children in care. This poses a potential risk to the health of children in care.

Reporting Requirement.The licensee shall report to the Department any of the events: Any child absence means any instance where a child in care is missing. For example, any child in care who wanders away from the Family Child Care Home, is lost during an outing, or does not return from school, shall be reported even if the child is later found safe. This requirement is not met as evidence by: Based on LPA’s interview and record review, C1 wandered away from the daycare on 10/17/22 and licensee failed to report the incident to the Department. This pose a potential risk to the health of the children in care.

OPERATION OF A FAMILY CHILD CARE HOME

102417(a) Operation of a Family Child Care Home. Licensee shall be present in the home and shall ensure that children in care are supervised at all times. This requirement is not met as evidence by: Based on S1's disclosure, C1 wandered away from the facility without the knowledge and supervision of an adult. C1 walked away unnoticed from the front door toward Springbrook Elementary. This pose an immediate risk to the health and safety of the children in care. An immediate $500 civil penalty is being assessed today.

PERSONAL RIGHTS

102423(a)(2) (a) Each child receiving services from a family childcare home shall have certain rights that shall not be waived or abridged by the licensee….. (2) To receive safe, healthful, and comfortable accommodations……This requirement is not met as evidence by: Based on LPAs interviews and pictures reviewed. S2 stated the rash was noticed on C1 when S2 changed C1’s diaper after nap. S3 disclosed last month a rash was noticed on C1. This poses an immediate risk to the health of the children in care.
