What the inspector wrote

Page 2 of 2 Today, LPA interviewed 5 adults. Adult # 1 (A1), (A2),(A3) (A4) and (A5) During the course of interviews, A1 admitted that a 4 months old child was added to the capacity of 4 infants on 1/28/2025 for couple of hours. A1 admitted that A1 made a mistake to admit the 5th infant for that day for couple of hours which led to being out of infant capacity for Large Family Childcare Home. A2 admitted A2 was misunderstood regarding the presence of the 5th child for that day. A3 also admitted they had the 5th infant on 1/28/2025 from 11:15 am to 1:00pm. A4 stated they had the 5th infant on 1/28/2025 for a short time. A4 is not sure about the exact time of the 5th infant's presence. A5 was not present on 1/28/2025. However, A5 confirmed that A5 had not observed more than 4 infants at the facility on any time given. LPA reviewed 12 children's file and the roster of the present enrolled children. As of today, there are 4 infants enrolled on the roster. Based on the interviews with A1, A2, A3, A4 and A5 and reviewing documents and evidence submitted to LPA for investigation, it was determined the preponderance of evidence standard has been met, the allegation of " Provider is operating out of capacity\342\200\235 is found to be SUBSTANTIATED. The facility had 5 infants on 1/28/2025 which is out of the capacity of infants for Large Family Childcare Home. The total capacity of infants shall not be more that 4 infants at any one time. In the areas that were evaluated, the following deficiency was observed of the California Code of Regulations, Title 22, Division 12 on this inspection. Please see LIC 809D for details of deficiency. Licensees were informed that the \342\200\234Notice of Site Visit\342\200\235 must be posted for 30 consecutive days. The \342\200\234Notice of Site Visit\342\200\235 must be posted on or adjacent to the door. Failure to post will result in Civil Penalties of $100.00. LPA Malek informed the licensees that this report dated 2/3/2025 documents type A citation shall be posted for 30 consecutive days as there is immediate risks to the health, safety, or personal rights of children in care. Also, LPA Malek informed the licensees to provide a copy of this licensing report dated 2/3/2025 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. Licensees were provided with a copy of their appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days. The exit interview was conducted with licensees Sepideh, and Siavash Tehrani. End of report

This is an immediate risk to the health and safety of children in care.
