What the inspector wrote

Regarding allegation: Provider did not pick up day care child in a timely manner. During the initial inspection dated 9/6/23, LPA used Language Links to conduct interview with Licensee and attempted to interview 2 children including C1, but both children refused to talk to LPA. Staff #1 (S1) stated C1 was picked up about 14 minutes late on 8/23/23 and 10 minutes late on 9/5/23 because C1\342\200\231s parent called S1 to pick up C1 after school ended. LPA Duron interviewed 3 parents. All interviewed parents stated they did not have any concern with facility. Regarding allegation: Provider did not properly restrain day care child in vehicle. During the staff interview, S1 and S2 stated they have car seats and booster seats for the children they pick up from the elementary school . S1 and S2 also stated they make sure the children wear seat belt when traveling in vehicles. Both staff S1 and S2 denied that they did not properly restrain day care child in vehicle. During the inspection dated 9/6/23 and 10/24/23, LPA Duron observed 1 car seat and 2 booster seats in the facility. Based on the information gathered from LPAs\342\200\231 interviews, observation, and reviewing records, there is insufficient evidence to corroborate the allegations of provider did not properly restrain day care child in vehicle and provider did not pick up day care child in a timely manner. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the allegations did or did not occur in the day care facility, therefore the allegations are UNSUBSTANTIATED. An exit interview was completed. The report was reviewed and discussed. Appeal Rights were provided. The facility representative was provided a copy of their appeal rights and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Licensing office within 15 business days. Any proposed changes to the physical plant, including telephone number, shall be immediately reported to the Department. The facility representative was informed that the \342\200\234Notice of Site Visit\342\200\235 must be posted for 30 consecutive days. Failure to post will result in Civil Penalties of $100.00. The \342\200\234Notice of Site Visit\342\200\235 must be posted on or adjacent to the door. Page 2 of 2. End of report.

This poses a potential health and safety rish to children in care.

  • ARTICLE 2. Administration of Child Day Care Licensing

    1596.8662(b) (1)  On or before March 30, 2018, a person who, on January 1, 2018, is a licensed child care provider, administrator, or employee .... shall complete the mandated reporter training ... renewal mandated reporter training every two years following the date on which he or she completed the initial mandated reporter training.This requirement is not met as evidenced by: Based on observation and review, proof of completion of required mandated reporter training was not available for review during today's inspection. This poses a potential health and safety risk to children in care.

  • Family Day Care Homes

    1597.622(a) (1) Commencing September 1, 2016, a person shall not be employed or volunteer at a family day care home if he or she has not been immunized against influenza, pertussis, and measles. Each employee,volunteer...between August 1 and December 1 of each year.This requirement is not met as evidenced by: Based on observation and review the licensee's assistant was unable to provide proof of immunization against measles and pertussis. This poses a potential health and safety risk to children in care.
