On 10/9/2025 Licensing Program Analyst (LPA), K. Trinh conducted an onsite inspection for the purpose of an Annual Random. LPA observed licensee and assistant caring for twelve (12) children which included one (1) infant and eleven (11) preschool age children playing in the backyard. Licensee was operating within the licensed capacity as specified on license. Facility Day care hours are 8:45AM-3:30PM, Tuesday through Friday. A review of the Facility Personnel Report Summary on this date indicates all facility residents, staff, or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions. Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated. During today\342\200\231s inspection, LPA and licensee toured the inside and outside areas identified in the facility sketch as accessible to child care children. Off limits areas are made inaccessible by means of baby gates and locks. The child care area consists of the dining room area, children's bathroom and backyard. Parents drop off and pick up their children from the side door gate on the back yard area. There are working carbon monoxide, smoke detector, and fire extinguishers in the home that meet statutory and State Fire Marshall standards. (Continue to page 2) (Page 2) Detergents, cleaning compounds, medicines, and other items which could pose a danger if readily available to children were stored inaccessible to children. There were no poisons or other items observed which could pose a danger to children or if they were observed, they were locked or inaccessible. There are chickens kept in a cage in the back yard area. LPA verified that the two (2) firearms and ammunition were stored and locked as required and were inaccessible to the children. There is a fireplace in the living room and was inaccessible to children in care. The home has age-appropriate toys for the ages served. LPA verified there is a working telephone service (cellular service), licensee was reminded that childcare phone needs to remain in the childcare at all times. LPA inspected and verified safety requirements for the spa on the premises. LPA observed two (2), five-gallon buckets of water and a water fountain in the backyard; see LIC 809D for deficiency. Licensee\342\200\231s file was reviewed during the facility inspection on this date. Licensee possesses a current EMSA approved Pediatric CPR/First Aid certifications, which expires 10/9/2025. Beginning September 1, 2016, Health and Safety (H&S) 1597.622 states, a person shall not be employed or volunteer at a family childcare home if he or she has not been immunized against influenza, pertussis, and measles. Proof of immunization against influenza, pertussis, and measles for licensee was reviewed and within compliance. Beginning March 31, 2018, H&S Code 1596.8662 requires all licensed providers and employees to complete mandated reporting training and to renew the training every two years. Licensee\342\200\231s mandated reporter training certificate expires 7/7/2026. Five (5) children's records were reviewed, and there was a separate, complete, and current record for five (5) children\342\200\231s files. In the areas reviewed, the children\342\200\231s files were found to be in full compliance. The outdoor activity space was inspected for compliance. The space was enclosed by a fence at least five feet in height. The surface of the outdoor activity space was maintained and free of hazards. There were age-appropriate toys and materials for children in care. Incidental Medical Services (IMS) policy was discussed. Children are not to be left alone in parked vehicles. When the licensee is temporarily absent from the facility, arrangements must be made for a qualified substitute adult to care for and supervise children while absent. The substitute adult must have the required criminal record clearance, child abuse index clearance, immunizations, Pediatric CPR/First Aid, and mandated reporter training. CCLD website www.cdss.ca.gov/inforesources/community-care-licensing was provided to licensee to access regulations, updates, and licensing forms. Licensee was advised to register through childcareadvocatesprogram@dss.ca.gov in order to receive quarterly updates. Licensee was advised of their responsibility to review the Provider Information Notices (PIN) found on the CCLD website. A copy of the California Department of Social Services Lead Information Brochure was explained and provided to the licensee. LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. (Continue to page 4) (Page 4) Based on LPAs\342\200\231 observations, the following violation was observed and is being cited in accordance with California Code of Regulations, Title 22, Division 12, Chapter 1. Licensee was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain childcare by connecting them to childcare providers and Resource and Referral Agencies (R&Rs) throughout California. During the exit interview, licensee, Gabrielle Smith, confirmed that there are no Registered Sex Offenders living in the facility, and LPA completed the RSO profile in FAS. Appeal Rights were explained. The Licensee was provided with a copy of appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days. First level appeals should be sent to the regional manager at the address listed above. A notice of site visit was given and must remain posted for 30 days. Exit interview conducted and report was reviewed with the licensee, Gabrielle Smith. End of report.
