What the inspector wrote

On 10/09/2023, Licensing Program Analyst (LPA) Romy Castanon conducted a Case Management due to deficiencies observed during today's inspection. LPA Castanon met with Licensee Emilia Montano. LPA observed a 6 daycare children, Assistant #1 (A1) and Assistant #2. Emilia's own 3 three children were also present during the visit. A review of the Facility Personnel Report Summary on 10/09/2023 indicates all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions. During LPA\342\200\231s tour of the facility, LPA observed Licensee cleaning spilled liquid on the floor of the kitchen. There were 3 infants being fed in the daycare room (home's den) by Assistant #1 and Assistant #2. LPA asked A1 if only 3 infants were in attendance, A1 stated, the other children were playing outside. LPA opened the sliding door and observed 3 preschool age children playing on the right side of the backyard unsupervised and not within sight of A1's position. LPA stayed in the backyard and waited approximately 5 minutes for Licensee to join the children outside. Licensee stated she was outside but was called inside to clean and asked A1 to keep an eye out for the children. LPA explained the risks of leaving the children unattended outdoors. Based on LPA\342\200\231s observation and interview with Licensee, the facility is being cited in accordance with California Code of Regulations, Title 22, Division 12, Section 102417(g)(6) Operation of a Family Child Care Home. Appeal Rights were discussed. The facility representative was provided a copy of their appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days. A notice of site visit was given and must remain posted for 30 days. Exit interview was conducted and report was reviewed with Licensee Emilia Montano. Upon receipt, licensee shall post and provide copies of this licensing report to parents/guardians of children in care at the facility and to parents/guardians of children newly enrolled at the facility during the next 12 months. Licensee shall have LIC9224 (Acknowledgement of Receipt) signed and kept in each child's file. (End of Report)

This is an immediate risk to the health, safety or personal rights to children in care.
