What the inspector wrote

On 03/02/2026, Licensing Program Analyst (LPA), K. Navar conducted an unannounced case management inspection due to licensee's request to increase licensed capacity from a small family childcare home to a large family childcare home. Fire clearance from the Orange County Fire Authority was received and approved for a large family childcare home on 02/18/2026. The regulations for Large FCC Home were reviewed. LPA toured the facility with licensee, Maria Rodriguez. The licensee stated that the total enrollment is 5 (five) children, and that children are on a staggered schedule and arrive at different times throughout the day and are aware that they cannot exceed the capacity for a small FCC home ratio of 8 children at any one time. Licensee was operating within the licensed capacity as specified on license. Per the licensee, operation hours will be Monday through Friday, 7:00 AM- 5:00 PM. Care and supervision will be provided to children ages newborn (infant) to school age. For the purposes of licensing, an infant is defined as any child 0 to 24 months of age. During today\342\200\231s inspection LPA verified there is a working telephone service (cellular service), licensee was reminded that childcare phone needs to remain the in the childcare at all times. Currently there are 2 adults including the licensee and 4 minor children living in the home. A review of adults' records on today's date indicates that all adults who live in the home or individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions. Continue to page 2. Page 2 All areas on the Facility Sketch LIC999 were inspected, including but not limited to, off-limits areas. The facility is a 1-story home with 3 bedrooms, 2 bathrooms, living room, kitchen, laundry room, patio (fenced), and a garage. Licensee has designated the laundry room, garage, bedroom 1 (one) and bedroom 2 (two) as the off-limits areas. The licensee has locks and child safety gates to ensure off limit areas are inaccessible to children in care. The licensee has designated the living room, children\342\200\231s bathroom, and patio as designated day care areas. Areas that will be used by children were inspected for safety, comfort, cleanliness, ventilation, and heating. The childcare bathroom is located in the hallway and was observed to be safe and free of hazardous items. The designated childcare areas were observed to have age-appropriate toys. Detergents, cleaning compounds, medicines, sharp objects, and hazardous items that can pose a danger to children are inaccessible in areas designated for children. All drawers and cabinets in reach that have hazardous items have safety latches. The licensee stated that there are no poisons on the premises and LPA did not observe any. The licensee was advised that any poison must be locked with a key or combination lock. The licensee stated that there are no weapons or firearms on the premises. The LPA informed the licensee that when firearms are present, they must be locked and stored separately from the ammunition per CCR 102417(g)(4)(C). The fire extinguisher type 2A-10BC must be serviced annually or as often as necessary. The pressure gauge on the 2A-10BC fire extinguisher(s) indicates fully charged, as indicated on the service tag observed. Smoke and carbon monoxide detectors were tested and are operable. Smoke and carbon monoxide detectors should be checked, and batteries replaced as needed. Emergency drill last documented 11/2025. Outdoor play activities will be conducted in the back patio area. Patio has one gate that leads to courtyard area of complex that is locked and accessed with a key. Outdoor patio was inspected and to be free of hazardous items and to have age-appropriate toys. There are no bodies of water on the premises. Licensee stated there is a community pool that is located about 5-8 minute walk from facility and is accessed by a key phob. Licensee stated they will not be using the community pool. Continue to page 3 Page 3 The licensee stated food is provided for the children in care. LPA reminded licensee that if children bring food from home, the children\342\200\231s names must be labeled on their lunch bags and refrigerated/stored properly. The licensee understands that there shall be one crib or play yard for each infant who is unable to climb out of the crib or play yard. The licensee\342\200\231s Pediatric CPR/First Aid certification expires 08/2027. Beginning September 1, 2016, Health and Safety (H&S) 1597.622 states, a person shall not be employed or volunteer at a family childcare home if he or she has not been immunized against influenza, pertussis, and measles. Proof of immunization against pertussis, measles for licensee were reviewed and within compliance. Beginning March 31, 2018, H&S Code 1596.8662 requires all licensed providers and employees to complete mandated reporting training, and to renew the training every two years. Certification Exp. date: 10/2027. LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-andresources/safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02- CCP. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. The licensee understands she must be present in the facility and must ensure children in care are always supervised. Children are not to be left alone in parked vehicles. When the licensee is temporarily absent from the facility, arrangements must be made for a qualified substitute adult to care and supervise children while absent. The substitute adult must have the required criminal record, child abuse index clearances, immunizations, Pediatric CPR/First Aid, and mandated reporter training. LPA provided Guardian Information and website info: https://www.cdss.ca.gov/inforesources/cdss-programs/community-care-licensing/caregiver-background-check/guardian Continue to page 4 Page 4 Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated. CCLD website www.cdss.ca.gov/inforesources/community-care-licensing was provided to licensee to access regulations, updates, and licensing forms. Licensee was advised to register through childcareadvocatesprogram@dss.ca.gov in order to receive quarterly updates. Licensee was advised of their responsibility to review the Provider Information Notices (PIN) found on the CCLD website. During the exit interview, the LICENSEE Maria Rodriguez, confirmed that there are no Registered Sex Offenders living in the facility and LPA completed the RSO profile in FAS. Licensee was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain childcare by connecting them to childcare providers and Resource and Referral Agencies (R&Rs) throughout California Reporting Requirements: Changes should be reported to the Department as soon as they occur, such as construction, remodeling, telephone number changes, and/or moving out from your home. Any unusual incidents or injuries must be reported to the Department within 24 hours via telephone and within seven (7) days in writing. In the areas that were evaluated, NO deficiencies were observed of the California Code of Regulations, Title 22, Division 12 at the time of the visit. LPA informed licensee that a final review of the file will be done before the large family childcare license is issued. The licensee will be notified if any corrections or additional information is needed. Pending review and approval, a large family childcare license will be granted. Exit interview was conducted with licensee Maria Rodriguez. Notice of Site Visit was posted during the visit. Facility representative was informed that the notice of site visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100.
