What the inspector wrote

Page 2. The complaint received on 03/23/2021 alleged that there was a child left alone without supervision, the complaint also stated the infant room was not properly equipped. The complaint stated a Teacher directed a child to go to the bathroom alone and the child was found standing on an object in the bathroom window that was not secure. During the initial 10 Day Tele-Inspection LPA Corral conducted a walk-through of the Infant Room and the Infant Restroom. LPA Corral also conducted interviews with 3 Staff member and questioned the above allegations. During one of the Staff interviews the Staff described the windows in the bathroom to be high and stated the children cannot reach the windows. The Staff also stated the windows in the bathroom do not have screens but are above 5 feet high. Another interview with a different Staff member confirmed that the windows in the restroom can open but they are not opened because they do not have a screen on them. Both staff members stated they consider the infant room equipment to be adequate. When LPA Corral questioned Staff member regarding infant supervision, Staff stated she has not observed infants to be left alone or unsupervised. LPA Corral attempted to interview the alleged teacher who directed the child to go to the bathroom alone on three different occasions but was unable to get ahold of the teacher. During the course of the interviews LPA Corral was unable to confirm who witness the child standing on the object in the bathroom due to inconsistent statements by Staff. During the tele-inspection on 04/02/2021 LPA Corral did not observe the windows in the bathroom to be opened. LPA Corral asked Director to attempt to open the bathroom windows, but Director stated they were locked and hard to be opened by the children. Director stated bathroom windows remain closed. Based on the interviews that LPA Corral conducted, the Tele-Inspection completed, there is insufficient evidence to corroborate that a Child was left alone without supervision and that the Infant room is not properly equipped. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the allegations did or did not occur, therefore both of the allegations are Unsubstantiated . Exit interview was conducted and report was read to Director Deepika Wijegunaratne via Tele-Inspection. A copy of the Investigation Report along with Appeal Rights will be email to Director with a Read Receipt requested to acknowledge report was received. Director was asked to respond to email by copying and pasting \342\200\234I have read and received the Report and Appeal Rights, I acknowledge receipt." Appeal Rights were explained. Licensee was informed first level of appeal is directed to Regional Manager to the address listed above. Notice of Site Visit was not posted due to Tele-Investigation COVID-19 State of Emergency.     101416.5 - Staff-Infant Ratio(b) There shall be a ratio of one teacher for every four infants in attendance. This requirement is not met as evidenced by: Based on LPA Corral record review, sign in and sign out sheets show 5 infants in care from 03/15/2021 – 03/18/2021. Two staff members also stated Infant Ratio was over capacity in March 2021. This poses an immediate Health and Safety risk to the children in care.
