What the inspector wrote

Licensing Program Analysts(LPA) Tran conducted a case management inspection to follow up on a self-report unusual incident that was submitted to CCL Regional Licensing Office on 07/07/2022. It was reported by Timothy Bishop, Owner via fax at 10:20 a.m. According to Mr. Bishop, the unusual incident occurred on 07/06/2022, when child # 1 (C1) was behaving disruptive in class and when being redirected by the teacher Staff #1 (S1), C1 struck S1 with a hand-held magnifying glasses. S1 was not injured and informed the Executive Director Ana Salinas who came to assist and brought child to the office so C1 calm down. When C1 was picked up by the parents at 2:36pm. C1 told parents that S1 slapped C1 during the incident. Parent was upset and threaten to call Police if the facility did not fire S1. An internal investigation was conducted and S1 denied of having physical contact with C1. Staff #2 (S2), who was also in the classroom, provided statements that they did not witness S1 had physical contact with C1. Owner, and Director both attested that there was no sign of physical confrontation, no visible marks on child, nor child did ever make any comments to anyone about being slapped while child was at school. Owner Bishop and Director of Education Natalie Walker met with C1's parents the next morning and parents accepted the finding of the internal investigation. Child continued to attend the school and C1 was moved to a different classroom as parent's request. During today's inspection a tour of the facility was conducted. There were 124 children in 8 classrooms; with 17 staff supervising. A review of staff records on this date indicates that all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances. During today's inspection, 5 staff members and 5 children were interviewed. Facility's Discipline Policy and Procedure were also reviewed. During interviews, all interviewed staffs described discipline policy as encouraging self-control, responsibility and cooperation, by staff giving directions and space for child to calm down. 5 out of 5 interviewed staff denied that they have ever witnessed any teacher ever hit a child. 4 out of 5 interviewed children, who were present during the incident, denied that they had ever witnessed any teacher hit any child, except C1, who said S1 hit him but was unable to give details of the incident. (Continue next page) (Page 2 of Report) LPA also reviewed staff rosters, children rosters, facility Discipline Policy and Procedure in Parent Handbook, incident report and records of internal investigation and communication with C1's parents. The Policy stated that staff were trained in the process of positive discipline, giving children's instruction and space to allow child to calm down, regain self-control and promote learning in a safe environment. Discipline Procedure involved several steps, including teacher informing the Director to assist calming child down, documentation, informing parents, parents conference. Facility was able to provide records of all the steps were taken appropriately to address the concern. Based on LPA's interviews which were conducted with 5 staff and 5 children, and records review of the Discipline Policy and Procedure, documentation of internal investigation an communication with parents, there is no evidence to support any violation of Title 22 regulations. No Title 22 deficiencies cited during today's inspection. Exit interview was conducted with Director Ana Salinas. Report reviewed and discussed. Notice of Site Visit was posted during the visit. Facility representative was informed that the Notice of Site Visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100. Appeal rights provided and explained. The facility representative was provided a copy of their appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights.
