What the inspector wrote

During the course of investigation, LPA interviewed 5 staff members and 4 parents, and reviewed records. Regarding allegations (1) The facility was/is out of ratio. LPA interviewed 5 staff members. 5 out of 5 staff stated they have not witnessed facility being out of ratio. Staff 1 (S1) stated during the day the ratio is 1 staff with 4 infants. During nap time, one teacher supervises less than 12 infants, and the infants are on their beds. S2 stated, during the day the ratio is 1 staff with 4 children. S2 stated, staff will call Director if staff are going to be out of ratio and to inform them to send coverage. LPA reviewed Employee Time sheets, Children Sign in/out and face to name sheets for 4/2/24. LPA reviewed records for Toddler 1 classroom on 4/2/24 and observed 11 children present with 3 staff . At 1:00pm to 2:00pm during nap time, LPA observed 11 children with 1 staff according to face to name sheet and employee time sheets and children sign in/out sheets. LPA reviewed records for Toddler 2 classroom on 4/2/24 and observed 11 children with 3 staff present. At 1:00pm during nap time, LPA observed 11 children with 1 staff and at 2:00pm during nap time LPA observed 8 children with 2 staff according to face to name sheet. Regarding allegations (2) Infant was restricted to the cot and forced to sleep. LPA interviewed 5 staff members. 5 out of 5 staff stated they have not witnessed infants restricted to the cot and forced to sleep. All 5 staff denied restricting the infant to the cot and forced them to sleep. S2 stated, staff will encourage children and ask, “where is your bed”, or "let's get a toy or a book", "can you please stay on your bed" or provide a toy or book and ask, “Do you want to cover the baby, or rest with the baby". Staff will sit with child so they will not disrupt the other children as they sleep. Staff 5 (S5) stated, staff will sit by child and get child a book or a soft toy if they do not want to nap, children are pretty good on their bed with toys or book. Regarding allegations (3) The cots were not arranged so as to provide a walkway. LPA interviewed 5 staff members. Staff 1 (S1) stated, the cots have about a chair length between each cot because the children toss and turn. The children might kick or hit another child so staff make sure there is enough room between the cots. S3 stated, cots are separated from one another, cots are 18 inches apart, staff and children need to be able to walk completely around the cot. S5 stated, staff place them about 3 feet apart, so staff and children have enough room to walk around them. Page 2 of 3 On 4/9/24, LPA reviewed the live camera footage in Toddler 1 and Toddler 2 classrooms. In Toddler 1 classroom at approximately 12:40pm to 12:d50pm, LPA observed 1 staff member with 9 children during nap time. LPA observed 2 children awake sitting on their cot, as S5 sat next to children and was patting their backs. LPA observed soft music playing. LPA observed Toddler 2 classroom at approximately 12:50 to 1:00pm. LPA observed 2 staff with 11 children during nap time. S2 was observed sitting on the floor by cots with children and patted child's back. S3 was observed sitting by a child crying by cot, S3 talked to child, and child walked back to cot with S3. S3 covered child with blanket and sat down next to child laying on cot. LPA observed soft music playing in Toddler 2 classroom. LPA observed children’s cots in Toddler 1 and Toddler 2 classrooms, cots were placed on floor by staff providing access to staff and children to walk around and in between cots. LPA Duron was unable to interview children due to child’s age and being nonverbal. LPA Duron interviewed 4 parents. All interviewed parents stated they did not have any concern with facility. Based on the information gathered from LPAs’ interviews, observation, and the reviewing of records, there is insufficient evidence to corroborate the allegations: The facility was/is out of ratio. Infant was restricted to the cot and forced to sleep. The cots were not arranged so as to provide a walkway. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the allegations did or did not occur in the day care facility, therefore the allegations are UNSUBSTANTIATED. An exit interview was completed. The report was reviewed and discussed. Appeal Rights were provided. The facility representative was provided a copy of their appeal rights and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Licensing office within 15 business days. Any proposed changes to the physical plant, including telephone number, shall be immediately reported to the Department. The facility representative was informed that the “Notice of Site Visit” must be posted for 30 consecutive days. Failure to post will result in Civil Penalties of $100.00. The “Notice of Site Visit” must be posted on or adjacent to the door. Page 3 of 3. End of Report.
