What the inspector wrote

(page 2) LPA interviewed parents of preschool children on 3/22/22. From these interviews LPA determined that there was a preponderance of evidence to further support that the allegation was substantiate, and that the facility has operated out of 1 teacher to 12 preschool children ratio. LPA gathered and reviewed documentation provided by the facility detailing Face to Name of teachers and preschool children in each preschool classroom for a 2 week period. Also gathered and reviewed is documentation of 7 days of preschool children sign in/out information. From this documentation LPA was unable to include this information as any preponderance of evidence to support the allegation of the facility operating out of ratio. Based on the information gathered over the course of the investigation by LPA, it was determined that the preponderance of evidence standard was met and the allegation of facility operating out of ratio, is substantiated. The substantiated allegation constitutes a violation of Teacher-Child Ratio; Title 22 Regulation section 101216.3(a).The A violation can be reviewed on the attached LIC9099D page. Due to the A violation cited during today's inspection, the licensee shall post and provide copies of the report to parents/guardians of the children in care at the facility by the next business day, and shall provide to the parents/guardians of children newly enrolled at the facility during the next 12 months. In addition, the licensee shall immediately post upon receipt the Proof of Correction for 30 consecutive days and provide a copy to current and enrolling parents. The licensee is to keep Acknowledgement Receipt (LIC 9224) signed by parents in each child\342\200\231s file . Failure to post Type A reports for 30 days will result in a Civil Penalty of $100.00 Appeal Rights and deficiencies were discussed. The facility representative was provided a copy of their appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days. A notice of site visit was given and must remain posted for 30 days. Exit interview conducted and report was reviewed with the director.

    Teacher-Child Ratio 101216.3(a) There shall be a ratio of one teacher visually observing and supervising no more than 12 children in attendance, except as specified in (b) and (c) below. This was not met as evidenced by:Based on information obtained from interviews with staff and parents, LPA has determined that around drop off times, about 2 to 4 days a week in the morning teachers are supervising more than 12 preschool children at one time for 5 to 15 minutes at one time. This presents an immediate health and safety risk to children in care.
