What the inspector wrote

An inspection was conducted at the facility by Licensing Program Analyst (LPA) Carmen Odom. A review of staff records indicates all facility staff or individuals who require caregiver background checks have received a criminal record clearance or exemption and a child abuse index clearance. Operating hours are 6:30 AM to 6:00 PM, Monday through Friday. This facility is located on the campus of J H McGaugh Elementary school and is operated by the Los Alamitos Unified School District. Upon arrival LPA met with Teacher, Megan Shade. LPA observed 17 preschool children and 2 staff members. Director Jean-Mari Dagarin arrived at 9:55am during LPA's inspection. During the inspection it was determined the facility is operating within its licensed capacity and within compliance of staffing ratios. The facility was toured inside and outside and the floor and yard plan were verified. The Seal Beach Community Swimming Pool is located on the opposite end of the campus. There is a fence surrounding the facility and children cannot access the secured swimming pool location. LPA confirmed with facility representative that firearms/weapons are not allowed or stored on premises. The facility appeared clean and orderly. The items which could pose a danger to children (disinfectants and cleaning solutions) were stored out of the reach of children. Poisons/Hazardous Items are not stored on site. All materials and surfaces accessible to children are toxic free. The children\342\200\231s bathrooms were observed to be in safe and sanitary operating conditions. All floors are clean and safe. Furniture and equipment are in good condition, free of sharp, lose or pointed parts. Food is provided by the elementary school cafeteria; breakfast, lunch and snacks are provided. Food prep areas appear clean and sanitary. Solid waste receptacles have a tight-fitting cover and are in good repair. Children nap on mats, and bedding is sent home daily to be laundered by parents. Continue to page 2. Page 2 There is drinking water available to children both indoors and outdoors. A current menu is posted in a prominent location viewable by an authorized representative. Menus are dated, kept on file for 30 days and viewable upon request. The facility has a working smoke detector, carbon monoxide detector, and fire extinguisher that meet statutory requirements. The playground was completely fenced. The playground equipment appeared in safe condition, and play area is free from hazards. There is sufficient rubber cushioning underneath climbing structures and/or play equipment to absorb falls. A random sample of 10 children's files were reviewed for documentation of the child\342\200\231s name, address, and telephone number of the child\342\200\231s authorized representative and of relatives or others that can assume responsibility for the child if the authorized representative cannot be reached when necessary (LIC 700) and a medical assessment. In the areas reviewed the children\342\200\231s files were found to be in full compliance. Sign in/out procedure was reviewed for compliance. The person who signs the child in and out uses their full legal signature and records the time of the day. The child is signed in and out for the person responsible for the child. Staff files for staff present during today\342\200\231s inspection were reviewed for a health screening, immunization\342\200\231s and mandated reporter training. At least one staff member present possesses current CPR/First Aid certifications, which expires 11/2022. During staff file review at 10:30am 1 out 4 files was missing the health screening LIC503 form, 1 file was out of compliance. Proof of immunization's against influenza (or written decline), pertussis and measles for employees present during today\342\200\231s inspection were reviewed and within compliance of SB 792. Beginning March 31, 2018, Health and Safety Code 1596.8662 requires all directors and employees to complete training as specified on their mandated reporter duties and to renew their training every two years, per A.B. 1207. Proof of completion as required by AB 1207 was observed in staff files. This facility provides Incidental Medical Services -IMS. LPA reviewed storage of medication, equipment/supplies, and reviewed children's, personnel, and administrative records. When any IMS is provided, an updated Plan of Operation that includes IMS must be submitted to the Department. Continue to page 3. Licensee was advised to register through childcareadvocatesprogram@dss.ca.gov in order to receive quarterly updates. Licensee was advised of their responsibility to review the Provider Information Notices (PIN) found on the CCLD website. A copy of the California Department of Social Services Lead Information Brochure was explained and provided to the licensee. LPA discussed the safe sleep regulations with Director and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee [facility representative] of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. Updated face covering guidance was provided and licensee was to continue to message the \342\200\234Three W\342\200\231s\342\200\235: Wash your hands. Watch your physical distance. Wear a mask. This face covering guidance is for all individuals 2 years and older, except for the exceptions (child\342\200\231s development, medical exemptions, etc.) that are outlined by CDPH. The facility was not in compliance and violations of the California Code of Regulations, Title 22, Division 12 were observed, discussed and cited at the time of the visit. The following violations of the California Code of Regulations, Title 22; Division 12, were observed and cited today: Personnel Requirements 101216(g)(1) and Personnel Requirements 101216(g)(2) (see LIC 809D). Facility representative was reminded that all adults 18 and over, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated. The Licensee was provided a copy of appeal rights (LIC 9058 01/16) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days. First level appeals should be sent to the regional manager to the address listed above.
