101428 Infant Care Personal Services (b) The infant shall be kept clean and dry at all times. (2) Each infant's/toddler’s clothing and diapers shall be changed as often as necessary to ensure that the infant/toddler is clean and dry at all times. This requirement is not met as evidenced by: Based on observation and interview, the licensee did not comply with the section cited above. On 3/26/2026, S2 did not feed the five (5) toddler children lunch and did not change the toddlers’ diapers frequently enough to keep them clean and dry at all times, which posed a potential health, safety, or personal rights risk to the person in care.

RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION

101229 Care and Supervision (a) The licensee shall provide care and supervision as necessary to meet the children's needs. (1) No child shall be left without the supervision of a teacher at any time. Supervision shall include visual observation. This requirement is not met as evidenced by: Based on observation and interview, the licensee did not comply with the section cited above. On 03/26/2026, at approximately 2:00 p.m., Staff 2 (S2) was asleep while caring for five (5) toddlers for approximately seven (7) minutes, S2 did not provide adequate supervision while the children were sleeping. This poses an immediate risk to the children in care's health and safety.

BUILDINGS AND GROUNDS

Based on observation and interview, the licensee did not comply with the section cited above. While touring the outdoor activity space at 11:30 a.m. LPA observed four cans of paint on top of the counter near the children's hand washing sink. The paint cans read "Warning! Harmful if inhaled." Assistant director stated the maintenance worker left the paint out which poses an immediate health, safety or personal rights risk to persons in care.

STAFF-INFANT RATIO

101416.5 Staff-Infant Ratio (b) There shall be a ratio of one teacher for every four infants in attendance.This requeriment was not met evidenced by: Based on LPAs interviews and record review, S#2 and S#11 did not meet qualification to work in the Toddler classroom and had worked in the Toddler classrooms on multiple occasions, this posed an immediate risk to the health, safety and personal rights of the children in care

101419(a)(2)(C) Documentation shall be maintained in the infant’s file... include the following: 1.Date. 2.Infant’s name.3.Time of each 15-minute check.4.Initials of staff person whoconducted each check.This requiremnet is not met evidenced by: Based on interview and record review, Staff Staff 2 and Staff 3 admitted that facility did not complete Sleep log for 6 toddlers in care prior to 03/10/2023, which poses a potential risk in health, safety and personal rights for the children in care.

ARTICLE 3. Administration

Based on interview and record review, the licensee did not comply with the section cited above, Director admitted that facility has not completed Lead Testing as of 03/16/2023, which posed a potential health, safety or personal rights risk to persons in care.

BUILDINGS AND GROUNDS

Based on observation, the licensee did not comply with the section cited above in 1 count out of 1 item, LPA observed a cleaning bottle, that stated Keep out of reach of children, located in a low shelf that is accessible to the children in the playground, which posed a potential health, safety risk to persons in care.

Based on record review, the licensee did not comply with the section cited above in 1 out of 1 staff, 1 staff did not have record of a TB test, which posed a potential health, safety or personal rights risk to persons in care.

PERSONNEL REQUIREMENTS

Based on record review, the licensee did not comply with the section cited above in 1 out of 1 staff, staff #1 did not have form LIC 503 Health Screening, which posed a potential health, safety or personal rights risk to persons in care.
