What the inspector wrote

On 03/22/2023 Licensing Program Analyst Stella Gutierrez made an unannounced visit for the purpose of a case management non compliance regulatory inspection. Upon arrival LPA was net by the site supervisor, Lexi Hall who provided LPA a tour of all three portables including classrooms 1. 2, 3, and 4. Census taken and LPA observed 15 school age children and 12 staff during the tour. A review of the Facility Personnel Report Summary conducted on 03/22/2023 indicates all facility staff or other individuals who required caregiver background checks have received criminal record and child abuse index clearances or exemptions. The site supervisor was reminded that all adults 18 and over, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated. During today's visit LPA observed 3 staff during transition from recess to classroom. The staff conducted headcount and match the name to the face. The director stated that the site supervisor stated that each parent has a PIN code and use the QR code Parents scanned to sign in or sign out a child has been place on the Staff badge to ensure there is visual engagement with Parents before the child is release. Sign in/out procedure was reviewed for compliance. The facility currently provides incidental medial services: LPA reviewed storage of medication and equipment/supplies, and reviewed children’s, personnel, and administrative records. Health screening and immunization's as required were reviewed. Beginning September 1, 2016, Health and Safety (H&S) 1596.7995 states, a person shall not be employed or volunteer at a day care center if he or she has not been immunized against influenza, pertussis, and measles. Proof of immunization against pertussis, measles for (licensee and assistant) were reviewed and within compliance. Beginning March 31, 2018, H&S Code 1596.8662 requires all licensed child care providers, administrators, or employees of a licensed child day care facility to complete the mandated reporter training , and to renew the training every two years. . At least one staff member present possesses current EMSA approved Pediatric CPR/First Aid certifications, whic h expires 12/2024. Children's records were reviewed, and there was a separate, complete and current record for each child. A random sample of 05 of children's files were reviewed for documentation of the child’s name, address, and telephone number of the child’s authorized representative and of relatives or others that can assume responsibility for the child if the authorized representative cannot be reached when necessary (LIC 700) and a medical assessment. In the areas reviewed the children’s files were found to be in full compliance. LPA was provided a copy of the updated personnel report and the disaster drill log and reviewed to be compliant. In the areas that were evaluated, no deficiencies were observed of the California Code of Regulations, Title 22, Division 12 at the time of the visit. Exit interview conducted and report was reviewed with the site supervisor, Lexie Hall . Appeal Rights were discussed. The facility representative was provided a copy of their appeal rights (LIC 9058 ) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
