What the inspector wrote

This is a follow up UIR Case Management Inspection from the initial visit on 04/25/23. A case management inspection was conducted today by Licensing Program Analyst (LPA), Odom who met with the Director, Karina Chavez. A self-report incident by the facility was received by regional office on 04/19/23 which stated at 2:32pm during nap time while parent was picking up child #1 (C1) upon removing blanket parent observed C1’s bottoms were down to their knees. Census was taken today and there was a total of 47 preschool age children with a total of 11 staff members, children were eating breakfast. A review of criminal record clearances indicates that all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions. During this investigation, LPA interviewed the 5 staff members, 1 parent and 1 child. LPA also obtained a copy of the children’s roster, personnel report, and daily classroom schedule. Through interviews conducted with staff, it was disclosed by both staff who were supervising children in the classroom during nap time from 12:30pm to 3:00pm they did not observe Child #1 (C1) move in their sleep, use the restroom, or wake up during nap time. All the staff disclosed C1 goes down to sleep quickly and children are encouraged to use the restroom before nap time. Staff #1 (S1) stated after the children came back inside from lunch at 12:15pm, the children began to get ready for nap time. S1 assisted child #2 (C2) for 20 minutes until child fell asleep and then went on to work on their daily highlights/notes. S1 stated they did not hear anyone cry, move, wake-up or get up from their cot. Staff #2 (S2) stated when they returned from lunch at 2:00pm to relieve S1 for lunch, all the children were still sleeping in their cots. S2 stated at 2:30pm when Parent #2 (P2) was picking up C1 during nap time upon removing the blanket S2 also observed C1’s bottoms were down to their knees. Continue to page 2 Page 2 P2 asked S2 if they knew why C1’s bottoms were down and S2 told P2 they did not know why, possibly C1 pulled them down during nap time. S2 stated from 2:00pm to 2:30pm they did not observe anyone move, wake up or get up from their cots. On 4/19/23 Parent #1 (P1) spoke with Director (S5) regarding the incident. S5 stated they conducted an internal investigation by interviewing staff and none of the staff disclosed observing anything. C1 disclosed they pulled their bottoms down during nap time reason unknown. C1 stated no one in the classroom pulled their bottoms down and they are happy in the childcare center. In the course of the investigation LPA interviewed P1 on 05/01/23. P1 stated they spoke with C1 on 4/19/23 by asking C1 if any of the staff had done anything to C1, C1 stated “no” with a confused look on their face. On the morning of 4/20/23 P1 again questioned C1 if anything happened during nap time and C1 responded with the same answer as the day before. P1 requested C1 to be moved to a different classroom. S5 moved C1 to a different classroom on 4/20/23. Based on the interviews conducted and the information obtained, there is not a preponderance of evidence to support C1’s personal rights were violated. There were no Title 22 deficiencies cited during today's inspection. Exit interview was conducted. Notice of Site Visit was posted during the visit. Director Karina Chavez was informed that the notice of site visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100. Appeal rights provided and explained. The Director was provided a copy of their appeal rights (LIC 9058 01/16) and their signature on this form acknowledges receipt of these rights. First level appeals should be sent to the regional manager to the address listed above.
